No, the van driver caused the accident. He should have been watching where he was going but instead chose to be baited into abusing the cyclist and not paying attention to the traffic in front of him.

No, the van driver caused the accident. He should have been watching where he was going but instead chose to be baited into abusing the cyclist and not paying attention to the traffic in front of him.
[troll mode] Does the cyclist making progress between two slow/stationery carriageways of traffic - not in a marked lane but straddling the markings - also contravene the law? And is it possible van man sees this 'offence' and thinks it necessary to upbrade the cyclist? Leading him to continue a discussion...[/troll mode]

Regardless of what the cyclist was doing (he could have been doing the lambada naked with a brony-tail stuck in his poop-hole - it doesn't matter) it is the responsibility of the van driver to be 100% in control of his vehicle and paying attention to what's going on around him and he failed to do so.

Whether the cyclist was riding badly or not does not excuse the van driver driving badly.

"between" being the critical work in this sentence. It's the van driver's responsibility to decide how to prioritise his attention. Choosing to prioritise communicating with the cyclist, rather than looking where he was going, was the "cause" that impacted on the third party.

I have NOT once ignored the basic wrongs that were shown by the van driver or that the shunt was 100% his fault....SHOW me where I have.

IF you think there is no "effect" caused by the interaction that WAS started by the cyclist choosing to shout at the Van driver then you live in a rare old world and ignore simple "cause and effect" to give yourself something to argue with.....

I say again...
The VAN is 100% responsible for the shunt
There is a Cause & Effect that cannot be dismissed, eg the initial interaction by the cyclist.

Whatever the reason is (I found myself mildly distracted by rather nice Porsche this morning. Often it takes a nice lady to distract me, especially if there's a bottom involved) it's usually largely irrelevant.

I know there are people on here wanting to blame cyclists for absolutely everything, but we really can't blame them for the bad driving of others.

The cause is his bad driving. The effect is his running into the car in front.

The cause of his bad driving is debatable and irrelevant, but if you think the cause is the cyclist, what caused the cyclist to shout at him, if not his bad driving?
