For the mismatch to be that clearly visible on a photograph, it must be really very obvious indeed on the car. It's really quite bad!!

Does the 335d have a DPF, I'd be more worried about a 5/6 year old diesel only doing 5000miles a year. If the old boy only did lots of short journeys to the shops/mens club and back etc

I agree with earlier comments if you can't see the problem with colour match, either there is a problem with your computer or you should have gone to Specsavers.
Apart from colour issue they have hard masked repairs instead of fading it out as a skilled painter would have done.
To me this looks like a DIY job done on a Sunday morning on a drive with a can from Halfrauds... take it back.

OP - To put things in perspective I picked up a 3yr old BMW AUC 635d a few years back for a not inconsiderable sum. I collected the car late on a wet evening and the car had been "prepped" to the usual high standard you'd expect at a busy dealership, quick hoover, jet wash and that shiny greasy polish crap on everything.

Being a PH'er I was looking forward to spending some time cleaning the car so I paid no attention. Some products later the outside was looking a deep gloss black, so I tackled the inside and went at the beige / slightly grubby leather with my trusted meguires cleaner (stuff i'd used millions of times). A few minutes I nearly shat myself as big clumps of the paint came off the middle of the seat base -yes I did test elsewhere first. So I drove to my local BMW not the one i purchased from due to distance and asked their valeter to take a look. He came back saying that his leather used to prep new cars had had the same result and most definitely the seats had been shoddily repainted and not sealed.

Of course the car went straight back to the dealer were they confirmed the fact they had sought to cover up and offered to repaint again to a higher standard. As i was still attached to the car I agreed but if I'm honest the seats never looked right to me again and I ended up shifting the car on in a matter of months.

So long story short if you're not happy keep up the fight or hand it back. The small things eat away at the experience.

What a load of tosh, yes there are some cowboys out there as they have bought a van from Ebay but most of us can do the job to a high standard better than some bodyshops.

I'm a Smart repairer and I'm sure if this were true of my work I wouldn't get called by a top pro detailing company to do jobs on their customers cars

As with most trades its the cowboys that ruin it fir all. Ive seen alloy repairs where the have repaired kerb damage and allowed the paint and clear to blow through the spokes and paint over the wheel weights and brake dust on the inner rim.

Cheers for all of the comments, it's quite interesting to there are three clear camps:

1) Those who can see
2) Those who don't mind too much about the little details
3) Those who require the canine opinion of their hi-vis Labrador

BMW got back to me over the weekend, apologising, and have arranged to hopefully collect again on Wednesday. The salesman is apparently speaking to the paint guy today.... I'm assuming in between filming, Mr Maker offers his services to BMW. Fair play for them getting back to me and offering to fix it, I'm still a little dubious if they are using Mr Maker again though.
