I think it needs to be the default setting for the emission results to count. And not sure if a manual deactivation is actually allowed with current rules. Still don't quite understand what got them into the mess in the first place. OK, better consumption and more power vs. true NOX emissions -- perhaps they felt they needed the first to establish diesel in the US? But did they really think it works like in the EU? Here you just need to pass the standard test to be compliant, screw the spirit of the law*. Not so easy over the pond...
And what about farking up the recall in the US? It's not that this comes at them out of the blue... There is something seriously wrong with their management/quality organization for something this big to happen uncorrected.
- It's fun to look at e.g. the German transport minister who's in charge pretending to be all shocked and upset. They've know for ever that manufacturers cheat with emissions in the EU. They even blocked replacing the test cycle for something marginally better to protect interests.

Don't get me wrong, I dont go out of my way to destroy the environment but nature has a way of dealing with things aside from the fact that a cow emits more CO2 than most cars but I dont think farmers get taxed on cow emissions!

There was no "Scott free" , however Dred scot was a slave that tried to free himself ( unsuccessfully ) several times in the USA via the courts of law . Americans claim this is the origin of the term "Scott free" .
