Only a complete retard would cause criminal damage on the basis of ' your towbar is the same height as my dent'

Thanks for the useful and not so useful, but entertaining suggestions.

I have a VRN, mane and model from a drive past tonight and policy info from the MID. The car is taxed MOT'd and insured.

I will speak to them tomorrow. The worst that could happen in that the deny all knowledge in which case I'm no worse off.

Thread update time.

I paid the owner of the car a visit and told him I believed his car was reversed in to my car at the stated time and presented him with pictures of the damage including a height measurement of the dent and how that compares exactly with the height of his tow ball which had a cover with a shiny polished area on the rear most side.

He responded by stating his wife backed the car off the drive that morning but came in to the house asking his help as she couldn't negotiate the parked cars in the street. He also stated that he then drove the car away to run the errand his wife was intending to run.

Below is the email traffic between the owner of the suspect car and myself. Chronologically earliest on the top.

So, although they haven't stated "yes it was me", there is a tacit admission in the first email and it is implied that they have some responsibility it that they are offering to pay 50/50.

Incidentally, IMO the wing needs replacing along with the broken wheel arch liner.

No-one in their right mind would cough up a penny if they weren't guilty.

all this stuff about not quite sure and goodwill is nonsense


PS had it happen to me too, rear door and wing. Absolutely nothing to be done about it but put it behind you and get on with life

Sounds to me they've accepted liability.
I would start the ball rolling and accept their 50/50 contribution. Perhaps more than you would otherwise get .

I don't think you can buy replacement wings for e30 M3's can you? I thought they were hand made by panel beaters.

If you can buy them they are likely to be expensive to say the least.

I think a 50% contribution is fair enough given you have no witness. Just get it repaired and take it on the chin smile

The wing alone is £440, the liner £140. Add in fitting and paint of the wing and door, I'd say £1000 minimum.

Well that's going to cost a lot more than £300.

Sorry if I'm missing something here, but why aren't you just putting this through your insurance and letting them battle it out with the 3rd party?

Arent they metal factory flared arches on those and probably a small fortune if you can find one?

Edit :- answer provided whilst typing.
Based on what i have read id put it to your insurers as above. Tough pill to swallow for them if money is tight

Because I don't have a witness. I approached them to see if they would admit liability and then offer to go the insurance route. I don't think I have a cast iron admission of liability, and if I approach my insurance, I don't think it will fall in my favour and I'll be left with an excess to pay and loss of no-claims.

If the person who hit the car is insured then why is he struggling to afford the bill? His insurance will pay for it!!

Perhaps they should have been a bit more careful when reversing off their drive then?

I agree though - insurance is unlikely to go better than 50/50 so £150 is better than a kick in the teeth. The question is, will £300 at this body shop produce a decent result? Or will it be a poor blow over in the wrong shade?

The car is a product of a bare metal restoration by me. Trust me, it won't buff out.

I actually hit the wrong button and submitted that statement before i finished, was going to add ... " But they did the damage and its on them to sort it" or something similar before i got clumsy with the iphone, completely agree!

Could you try insurance first and if that yields nothing then just take the £150 or negotiate slightly more and put it down to experience without having to follow it through with insurers if they dont admit it? Then fix it somewhere on your terms, risky strategy keeping face with them perhaps
