Their reply seems 100% correct and right to me, they have answered all of your concerns and IMO they have got it completely Nailed on.

If I were you I'd take the £1000, get the small issues rectified (as per their letter) and move on!!

Yeah, but they've mis-represented the facts on several of those areas. The investigation findings also conflict with repair invoices I have in my possession stating there were clear errors with paintwork and exhaust valves - not that these things were fixed as good will. But that they FOUND a fault and fixed it.

The letter also leaves me in the same position I was in before albeit with a grand extra cash - they won't back or push any of the repairs but have simply left me to do all of that myself which is what got us into this mess in the first place.

Yes, people complaining about perceived poor value and customer service are the very core of modern day Britain's societal problems.

By the way aren't you the bloke who was whining in public about the cost and content of VMax and contending quite strongly as to how it should be run few months ago ? wink

We've settled.

It's not the ideal outcome that we were looking for but it was the best we were going to get. Our lawyer spoke 'off the record' with somebody at the Ombudsman service and they both agreed that although the situation was disappointing and there was a genuine case for wanting to reject the car the case wouldn't get anything more than what was offered as the car was never going to get replaced for the cosmetic items. The car would never have been rejected because of the ACC mostly due to lack of evidence on my part and any supporting cases online.

VWFS made a pretty monumental mistake by not including the words 'full and final settlement' after the good will gesture part of the letter. The lawyer and the ombudsman service have both agreed this is bad form and the ombudsman service will probably be taking that up with VWFS separately to my case just to remind them of the rules around offering settlements. VWFS quickly sent an email a few minutes after we spoke to them to clarify the goodwill was a settlement.

The VW Executive Office are looking to expedite the outstanding part and then the car will be booked in for repairs. Depending on if the part can be expedited or not I'll decide when it goes in for repair now or if we keep waiting for the part and do it all in one go. If the paint repairs are not completed to the required standard then our issue is with the supplying dealer and not VW UK or VWFS. Both the lawyer, the ombudsman service and VWFS said we were well within our rights to seek legal advice if the supplying dealer couldn't get it right. This would be handled through small claims and not the ombudsman service.

The VWFS man did say that if a turbo was to blow up or any other faults were found then I am still well within my rights to seek warranty repair or to complain to VW UK or VWFS but for the issues stated in the letter we were settled.

Thank you for the advice, words of encouragement and help shown here on PH. I'm very much looking forward to putting this all behind me.

You took the right option IMO. They weren't going to take the car back, take the settlement and get the car sorted and enjoy it.

I did read the letter as settlement even though they didn't say and I see it was heir intention that it be a settlement rather than just a GOGW!

Edit: My R has nothing but problems too. But hey-ho. I've persevered with it and will do for a few more months!
