New car painted wrong colour

Surely if a deposit was taken there has to be a valid contract of sale? How then can the dealer/AM pull out?

Or is there something going on that we're not being told?

They'll probably claim that goods aren't available to fulfil the contract to the other party's satisfaction (since they can't build an extra one in the right colour), so the contract is voided - with a full refund of all money paid so far.
