Isn't the OP's issue with the dealer not AML?
Not sure. As AM directly offered compensation i would think some liability is with them.

For all of you who think some major piece of information is missing it is not.

Having checked with my solicitors i pleased to say that buying a car and then selling it to make a profit is totally legal.

As i understanded it AM have told the dealer that they are no longer allowed to sell me the car because they think i will sell it on.

If i had wanted to sell it(which i didn't) there is nothing Aston Martin could have done about. To my knowledge no contract can legally be drawn up which forbids the sale of an item when it is sold to the new owner. The only notable exception to this is when the government subsidise property and then the owner of the property is not allowed to sell the property and profit from it.

Subsequently as the dealer is breaking their contract with me the dealer will be taken to court for substantial losses.

I'll just leave this here

Strictly speaking contracts can impose all kinds of terms that might ostensibly seem unreasonable, but if you sign it then you're agreeing to be bound by them.

Obviously if AM have no such contract then it's a different story.
Thanks. No agreement has been signed like this one. I will get the solicitors to look over that one though as it looks nonsense to me.

.
Not if the contract you are signing is not legally binding in the first place!

For everybody who thinks some vital information is missing, it is not.

I have had no heated exchanges or arguments with either the dealer or AM.

As things go i think i am a pretty undemanding customer and i'm sure many others would have had a lot more to say if their car had arrived in the wrong colour.

The issue is based around the fact that they think i will sell the car.

Perhaps it wasn't the best idea in the world to start this thread and a apologies to AM for that. I don't believe i have posted anything offensive on here and at worst have made some throwaway comments.

Although i am very disappointed at the situation i wish the AM brand well in the future.

Also as mentioned earlier, i'm sure this thread is not going to loose them any business but i'm sure they do care what is written about them on these pages.

So the dealer has got back to me and told me that i can buy the car now!

I'd like to thank all PHers who have taken the time to read and comment on this thread. It seem that the PH community is strong and they do have ability to make manufactures listen.

Thanks again.
bow

Sorry; been following this from afar...

So, they are now letting you buy the car but do you 'get anything' for the huge error they made with the colour etc?

It sounds like they may have 'won', if not. They've panicked you into thinking you may not get the car at all, so you gratefully accept the wrong car.

Apologies if I have misunderstood but you now seem very happy to be allowed to buy a different car than the one your ordered, for the same money?
They have offered some compensation but not what i was originally 'totally satisfied' with.

Any update OP? When is collection day?
Apologies for the long delay in updating.

Unfortunately there is no collection day for me. After having a good long think about it with a cool head, i decided that i did not want to buy it.

When spending such a large sum of money i feel that i should have what i ordered. This with the fact that they offered something as compensation and then went back on it, along with the appalling customer service made me decide i'd be better off buying something else.

I'd like to thank all of you once again for your comments and support on this matter.

OP what car are you going to go for then?
I'm not sure what i will go for at the moment.

I only want a manual so my choices are limited.

Possibly a 911R if prices drop once deliveries of the new GT3 start.
