This sounds like exactly the sort of issue I know someone on PH will know the answer to!

I live on a estate built just over 10 years ago, outside my property there is a channel drain that forms both a footpath and access road to the driveways of of my neighbours. The drain is currently in a bad state of repair, the metal grills are damaged and the concrete it fits into is crumbling. There isn't any sort of service/maintenance charge for the estate, so I assumed such maintenance would be councils responsibility. Picture:



I contacted the council however they advised: "Upon inspection the Aco drainage channel in your images does not form part of the adopted Highway. The inspector took photographs of his own and after checking our adoption records, it was found not to be under Highways jurisdiction.

This issue should be looked into by the Developer of the land itself which you should be able to view on your Title Deeds as the drainage channel is actually part of private land."

My title deeds only show my immediate property, so I can't verify their claims however assuming the council is correct, I was wondering would be responsible? Either the developers (who have been taken over since the development of the estate), the estate as a whole, or the few houses whose driveways lead from the access road.

As a builder I would expect the developer to have sold off sections of the road with each property to property. Do you have your title plan? If so it may show your house owns one part of the road and then it's up to finding who owns the part with the drains. It may be a shared responsibility as all houses have the use of it I assume.

Those gully channels should be haunched up with concrete, There appears to be very little & a lot of tarmac causing the channel to collapse. Poor workman ship & the developer should remove channels , relay heavier duty channels & fully haunch with a concrete . wet cut tarmac & relay hot taring joints.

Cheers, the developers of the estate were taken over (twice) and then their trading was name transferred to yet another company. I've finally found where the assets now lie, so will see what they say... although from further reading online I suspect the answer is that it is the homeowners responsibilities.
