The full transcript of this conversation is even more crazy. She makes a big deal that she has pulled over in her car because she feels talking on her phone and driving is dangerous. Nuts...

Surely they shouldnt be able to give her a ticket if they ahve no proof shes been driving. They could charge her with wasting police time though.

Thats why they have auto pilot just taxi onto the runway and flick a switch then sit back and have some crack relax and enjoy the flight

ban all the women, get them off the road! i joke i joke.. drink drive is a touchy subject, plus if when they breathalised her well after she had stopped driving and she still failed the test, how intoxicated was she during her drive home? she could have hit a car, or even worse... a pensioner!

For all of you, here is what they do (I worked for prosecution, not drunk driving, but you still learn how it works):
they check your alcohol level via a breathalyzer. They then take empiric tables that indicate the build-up and reduction of blood alcohol levels over time. It does not give the precise amount, nor the precise time.
With a second breathalyzer test, they can see if you are in the build-up, peak or reduction phase. Peak is assumed to be reached approx. 2 hours after you take a drink.
Blood samples are usually taken as breathealyzers are cosnidered to be not too precise and they have occasiobnally false positives or blanks.

Therefore, if they really want to get you, the whiskey bottle at the door-routine does not work very well: if they check you there and then, your alcohol level should be rather low and build up steeply afterwards, whereas if you have been drinking before, you are at an elevated level already and the additional drink will only cause a blip upwards. It makes things more difficult to prove, though, and pisses them off big time. On the other hand, it is the most common excuse heard by judges. And lets be honest:"Your honour, I was out with my friends, had 5 diet cokes, drove home and got totally pissed on whiskey on my own..." Would you believe that?

At college (about 4 years ago) my Psychology teacher told me that he had crashed his partners MX5 into a tree. He got his partner to pick him up intending to organise getting it towed etc the next day. Later that night the police turned up on his door step asking if he knew the car had been crashed and that it hadnt been stolen. He hadnt been drinking but asked them if they were going to breathalyze him. Apparently they said that he could have had a drink when he got home to calm his nerves after the accident so there would be no point. Maybe things have changed since then but it appears that the 'i had a drink afterwards' argument might stand in some cases depending on the circumstances. I guess it really depends on how long it took for them to come round after he crashed.

A bloke at work was reported to the police for driving eraticaly and they came to his room 4 hours later, breathalysed him and did him for DD, he went to court and sure enough has been banned. This was 4 hours later, they examined the alcohol in his blood and it showed the alcohol in his blood must have been there at the time he had driven.

So yes she can be done for it.

a freind of mine had a 300zx he had a drink in his then drove down to his mates, crashed it, drove it round the corner walked the rest of the way, they went over the town the next morning police knock on his door to ask about the car, he said hed crashed it then went over the town, he got a month ban for leaving the scene of an accident, much better than having a driving ban on ya license.

im a firm believer of the jail for drink drivers rule, i also think it should be a zero tolerance for drink driving, no maximum limit. wont be long i dont think
