So, you are drunk and have a crash.
Discussion
I would say they would pay out unless they have a policy saying they dont have to, so first time you would get paid out the second I doubt it.
My bother crashed our car (almost ten years ago, his first car the car I was learning to drive in) after a night on the piss, getting up after not enough sleep he ended up crashing, think he fell asleep and getting caught for drink driving.
Car was a write off, insurance paid out pretty much all we paid for it as it was only a few weeks old.

What if you were "drunk" and someone hit you from behind?
Then the other insurers deal with it, bu i suppose they could argue you shouldn't have been on the road in the first place.Never come across such a case as of yet though.

All mouth, no trousers (well, trousers round ankles). ICOBS 8.1.2(3) would prevent them refusing the claim unless the circumstances of the claim are connected to the breach or condition. OK so most accidents whilst drunk would be connected, but one can imagine a situation whereby it was immaterial.Noger said:

Please don't do this. It's very annoying.Still, hardly worth a comment is it.
I know of a girl who crashed whilst over the limit and took out a lamppost, the Police were on the scene and she was arrested, charged and convicted of drink driving.
Insurance paid out for her car
She got a bill from the council for the lamppost and the insurance company paid that too.

Three years ago a mate of mine was going through a dodgy divorce and went out to drown his sorrows. He woke up upside down in his car in someones front garden.
Got banned for 18 months and received a cheque from insurance company as his car was written off. Don't know who the insurer was though.

It's all depends what it says in your policy, most insurers would try to refuse to indemnify your losses if you are found to be over the DD limit, however will have to deal with the third party claims under RTA rules.
However some insurers surprisingly will still pay out for the clients damage when they have been drink driving and had an accidnt. I won't name names as that may be considered irresponsible but a very few will still pay out.
