Is it possible to trademark someone else's name - say a famous persons? or do you have to either be the person or work with the person ?

If you TM someone else's name with the intention of exploiting their name; then you will get in trouble. If you happen to have the same name - or a genuine use for the name - for business most likely - and the intention does not tie into the famous person at all... then you should be fine.
