A bit of advice please . I purchased a 3 month old BMW from a bmw dealer a couple of weeks ago . I have just found out that 2 of the extras shown in the advert /auc site are not actually on the car . The dealer has been made aware and I am waiting for feedback but where do I stand ? I purchased the car without viewing.
The missing option I'm concerned about is the Icon headlights

Have a look at The Consumer Rights Act 2015. Items must be of reasonable quality, fit for purpose and AS DESCRIBED.
If they do not satisfy any one of the criteria, you are entitled to a refund as long as you reject within 30 days from date of purchase.

Outside 30 days, you must give the retailer one opportunity to rectify, otyerwise you can have a refund or reduction in price.

I think you are in a really strong position. You can certainly return the car for a full refund, but depending on the value you place on the missing options, you might ask for a reduction to compensate. Clearly if the options are worth £3k to you, then the dealer will just ask you to return the car for a refund.

The dealer will most likely work with you on retrofit at their cost if reasonable, or a financial accessory or service/warranty compromise perhaps. If you like the car I would be cautious quoting the above from the off, as they may be put off helping in your favour. If you have the advert, it could be straightforward unless the options were without doubt a deal breaker if known then.

No desire to return the car . If the headlights can be retrofitted that would be great . Otherwise I would be looking for a sensible refund ??

I think it is highly unlikely that it would be cost effective to retrofit something as complex as icon adaptive lights, so it looks like it has to be some sort of refund.

I'd expect them to come to a deal with you - but that's not an option that will be worth an awful lot extra on a used car. There's a very good reason leased cars have most options built into a 3 or 4 year least, with a residual value of 0%.

Assuming it's got the regular LED's and not the icon ones then a refund would be ok.

If it's halogens then I'd be returning the car!
