found out yesterday that the Tax and MOT on my motorbike had ran out. So today I MOT the bike. go looking for the V5 so I can tax but cannot find. hmmm.

so I call DVLA who say the bike is not registered to me, the last owner must have not sent off the registration forms and that I need to complete a V62 and a V10.

I'd completely forgot about the registration documents... I only use the bike a few days a month and it just never occurred to me..

Here is the question, I have been using the bike, the tax ran out quite a while ago.. when I send off the forms to be transferred to me will I get fined for riding around untaxed?

Plus all the other ways. For starters, call the DVLA again and ask them to tell you hypothetically what would happen should you have done such a thing. You don't have to give a name.

Also, if no one knows you've been riding it about then say you've not been riding it about.

If it isn't registered in your name is your insurance valid? I would be more worried about riding around uninsured than not taxed.

If you haven't stacked it then I doubt insurance will be an issue. It is after all, a procedural cock up rather than a deliberate and fraudulent attempt to deceive.

I'd try using google, and then call DVLA if you need to.

Alternatively ride through lots of speed cameras to prompt the former keeper to register it correctly.

I'm fairly certain you'll be fine.

I get the impression that the fines only really kick in when the DVLA have to come hunting you down for the tax; I don't know anybody that has received a fine for taxing their vehicle late and I've known people who have gone 3-4 months before they've realised....

That said, how long has it been untaxed?

+ 18months. And I ride through central London regularly - do the cameras pick up untaxed vehicles?

Funny thing is I was riding to work around a month ago and a traffic cop flash his blues, I pulled over and he stopped just to mention my rear tyre was low, then pulled away...

I'm in the same situation as the OP. V5 must have never been sent off, untaxed for 8 or 9 months.

I'm sending off my V62 shortly. It might be worth adjusting the sale date on the V62 to last week to help prevent any further aggro??

Yeah, that is some good effort there....

Could be wrong, but I'd assume you are okay given that it has been that long and you haven't heard anything yet. I would have thought the gantry cameras would have caught you to be honest, but maybe it is only the VOSA vans that check tax...?

Seems odd that you haven't had a warning yet; then again, if the V5 isn't in your name then maybe the previous owner has been getting your warning/fine letters?

Where does everyone think the tickets and things go for an untaxed vehicle?
They don't magically know the OP now owns the bike so the old owner may well have a stack of them waiting for him why that wouldn't have reminded him to pull his finger out and send the correct details to the DVLA who knows.

My guess is he's a fine coming his way the second they know where to send it. 18 months + is probably outside of thier 'sorry I forgot' kindness window.

Update: As I couldn't remember the exact purchase date I used a family birthday and backdated the transfer date (more than 6 months). I also applied for the Tax to start the beginning of that month - not the full ownership term but better than nothing. Anyway this morning the V5 arrived and a letter to say the bike is now Taxed, they have started the Tax disc from the beginning of October, so just a few weeks..

You can insure a vehicle that's not registered in your name. Registered keeper is not necessarily legal owner and all that. Company cars are often registered to XYZ vehicle leasing co and insured by Joe Bloggs Manufacturing Ltd, for example.
