I have been sent a fake item on eBay. Photos/description of genuine OEM part, but cheap unbranded part sent instead.

I raised a return dispute but he's not interested. It says I have 8 days to work it out with him before eBay intervene. Is there any way to speed that up? Should I dispute direct with PayPal?

If you've already involved Ebay then don't involve Paypal - it will only confuse things. Chances are in 8 days time ebay will send you a refund & then take the money off the seller. You'll get to keep the item.

Nope. Have to wait the 8 days.
Seller may send you a shipping label through eBay to send it back or will harass you to post it yourself. Like a seller I am dealing with. tt.

Is it OK to leave negative feedback in the meantime? Or should I wait until the whole thing is resolved when eBay intervene?

I've been on eBay over 10 years and this will be the first negative feedback I leave. I've been sent fake items before, but never had a seller be so nasty and argumentative when they're in the wrong!

Ebay will refund you without hassle - they do when buyers are lying never mind when there's a legitimate case.

ebay only care about buyers, they don't give a crapola about sellers. Wait it out, you'll get a refund and keep the item unless seller sends funds for you to post or a shipping sticker. Buyers can return any item whenever they like for whatever reason they feel like at sellers expense. Ebay is ste.

Is that really true though? I had customer support on the phone who explained that if you return an item to a seller you would have to cover shipping costs unless it's not as described or damaged.
Every time i've rung up their support they have got back to me quickly and always been very pleasant and resolved the issue correctly.

YES It is true. E bay are heavily skewered towards buyers so much so its like dodge city at times. There are many many genuine buyers but there are also enough straight out lying thieving scum buyers to make it too risky to sell on there.
The buyer will get his refund.

Even if you have a "no return" policy on your sale, means diddly squat.

"if you dont send me a half refound ill give you negative feed backs its up to you no hard feeling...but the idem i receive is not like mine here so i wont use it or need it u must understand that. i gave you a few days if no return money is send my way ill negative feed back ya.if i do receive 1/2 the money i sended you (in total including the shipping) then ill gave you the best feed backs possible.

Basically bought a £7.50 item off me didn't check the description and complains it doesn't fit his item

I bought some gillette razor blades on ebay that turned out to be fake, and cut my face to bits. Ebay asked for me to get the item inspected at my own expense in order to prove they were fake. That would've cost about 10 times more than the razor blades.

Interestingly they didn't refund him. I got the case opened message and saw my paypal was now in negative. When I looked at the case one of the 4 options (you usually get 3) was "You don't want to refund him" but you can and it makes his experience better" I chose that option I also messaged him saying that as the item was accurately described with manufacturers part number and clear pictures I felt it was down to him just buying the wrong item. I clicked and sent the no refund reply. My money was almost immediately "released" back into paypal and my balance went back to what it was.
The messages are from him since. Effectively I refund him by 50% or else he gives me negative feedback. If I do what he wants He will give me great feedback I consider that to be blackmail. I became wary of him early on. I got his order and duly posted it to E Bays global shipping centre I didn't indicate in the original description that I would send it recorded delivery I simply posted it then marked it as dispatched and informed him. Almost immediately he accused me of lying and amusingly ironically being "non genuine" I told him I had posted it and would advise him once e bay notified me it had arrived at their global ship centre. I did this a few days later. Because I was wary of him I looked at his feedback and in particular the feedback he left for others. Intersetingly out of his last 10 left 4 were negative or neutral that made me suspicious about him.
In the past I had a guy leave me negative feedback on a transaction he cancelled shortly after buying it but before I dispatched it I sorted that out. More recently I had a guy try it on with me he bought something then used the not as described excuse to get a return. In his return thing he cocked up by saying it was both "not authentic" and also "the wrong type for his connection" effectively saying he had bought the wrong one. E bay still said I had to accept the return but the girl agreed to remove any feedback the buyer left. She also credited me with the return label cost. He was another one who when I looked at his feedback he left lots of negative and had amazingly bad " never received's" and "damaged in transits" I started contacting the people he had left negatives for that otherwise had unblemished records. Lo and behold of the 9 I contacted 7 responded. Their responses were basically he calimed it was damaged and it wasn't when sent out or he claimed it wasn't received I only had one and couldn't get him another I refunded anyway but still got neg" I mentioned to them that he seemed to have a higher than reasonable amount of leaving neg for people etc. 5 of those people did take it up with e bay and e bay removed the feedback
I fully expected him to be banned but he wasn't and again he is still trying it on with people.
There are some genuinely decent folk on e bay I sold an open vpn router on e bay a couple of weeks before xmas. The guy messaged me to ask if it was ok to use part of my description in his own ad as he was selling it on. His reasons were to do with the the fact that his previous vpn set up per device was better for him than running it on a router. I said yes of course its fine. Had he wanted to be a pain he could easily have just used the "not as described" routine he didn't and to be fair one of my regular buyers wants that type (dual band) vpn router so I have messaged him the buyer/ sellers details.
Thing is it seems now that for every decent buyer there is at least one complete st who will use e bays overly generous buyer protection programme to get stuff for free

Daft as it sounds inform Gillete and send a message to your local trading standards. The seller may just be a casual seller or a big time merchant. A few years ago Trading Standards in Cheshire went after a guy on e bay selling the faked SD and USB cards. I have reported sellers doing the faked Office Keys to Microsoft.

I've found people asking for fraudulent refunds often go quiet when you ask them them to raise an official case on eBay - they don't want eBay to know that they try this on with every seller.

Had a guy recently win my auction for a big photocopier, (pick up only) here in tampa. He won it for $10. He contacted me about my address, when I told him Tampa, I could hear him scratch his head.....he lives in NY NY!
