Hi Guys
I bought a 360 Spider like a month ago from a Ferrari main dealer, after about a week I had an issue with the metal on the inside of the hood mechanism cracking. The dealer collected the car from me, and remedied this issue.
Now the same thing has happened again yesterday, same crack in the hood structure.
I've not had an issue with the service at all, its been very fair, however now they are saying they will refund me for the car. Which i don't particularly want, I'd rather the hood was fixed?
I bought the car for a very fair price from them considering it was provided with a 2 year Ferrari Warranty, which no other 360's on the market currently have.
Where do I stand? Do i have to accept returning the car and get my money back or can i push for them to rectify the roof issue?

I had the same thing on my F430 which was under warranty and repaired by Ferrari at an (internal) invoice price of £1650.
The root cause of my issue was a slight misalignment in the roof frame, which was re-adjusted by Ferrari. I also beleive there are elastic straps under the hood which help the whole thing to retract correctly - they can often break and put undue stress on the mechanism.

So they will be arranging to collect my car and get this sorted now i believe. Glad they are sorting it, this is what the warranty is for but I think the warranty is an aftermarket insurance company and only kicks in after a certain timeframe so this will be coming from their pocket.
Hope you get it back soon.
I also suspect if the car is worth more now which it might be, maybe they're thinking they can sell it on for more money to someone else. Interested in your original question being answered about the law though, I'd like to think they'd have to buy it back off you for market rates if they insisted on having it back instead of repairing.

Yep I'd say the car is definitely worth more, i thought even at the time it was a very fair price for a Red/Crema car!
I'm waiting on them to collect the car from me now and get the hood sorted. Hopefully it all pans out as it should, I don't want to sell the car, was an effort finding the right car for me! haha

It'll be the magnesium frame components, of which there are four. As ridiculous as it sounds, you can buy them seperately for the 430 roof but not the 360, yet the entire roof mechanism is identical in every way (apart from the wind deflector) between the two models!!Gassing Station | Ferrari V8 | Top of Page | What's New | My Stuff
