OP if they're not letting return the car just enjoy it, there is no proof the car has been clocked (just speculation) it has FMBSH & all the features you want it's in good condition so be happy with your purchase.

I think you should bring your partner or someone who knows about cars & finance packages as you seem to be having a bad run.

Why on earth would you take it back to the garage you bought it from to MOT it?
They're hardly going to say there is something wrong with it when you've just bought it from them. (Mainly said in jest).

Just take it to a decent independent MOT station.

They put a charge on dealers house and lend.

Thing is car has been sold fit for purpose and meets its description.
There are no legal grounds for a refund.
However, as it was sold on finance, it belongs to the finance company until paid for.

The dealer does not have to offer a refund in this case.
It is for the finance company who now own the car to resolve, and if dealer won't refund as there is no legal reason to do so the customer may have to raise the funds to pay off by getting another party to pay the finance off and buy the car.

The 14 day cooling off period return is offered by the finance company and not the dealer.

And it is the relationship the dealer has with the finance company which will determine the outcome.

I am allowed to take the car back!!


Thanks to everyone who helped me with this.

I recorded a phone conversation with the dealer, with me saying you lied etc and him confirming the fact and sent it to finance company who called me today and said that I was correct and the dealer was lying to me.

The finance company reopened the case after the financial ombudsman got involved.

Without the help on here I would be stuck with it.

So thanks very much!

Good! Now please keep running the 5-series and just take on the excess mileage costs.... There's no point terminating that contract and buying another car, just see it out for the remaining year.

Or run the 3-series which they also have and still, apparently, have a year's finance on that. Why not just use it? It is 2012 and only done a 100k - should have years in it yet if looked after.

Run the 3-Series for a year, pay off the finance then look at the options. You state it is petrol - so what - a few extra quid on fuel will be vastly cheaper than buying another car you don't need IMO.

Taxi and it was also owned by Avis.
I recorded the phone convo with the dealer which I passed on to the finance company admitting he lied at point of sale etc etc.
That's why they agreed to return because obviously dealer saying one thing to me and one thing to finance company but luckily I could prove it.
Still suspect even now the mileage isn't genuine even if diagnostics didn't pick it up.
Looks like he sources cars from bca.

Still strangely low mileage for a taxi. Perhaps it was a hire car registered as a taxi to cover a breakdown or similar ?

I have bought a few cars from BCA for my own personal use and very good cars they were.

Not every car that goes through the auctions has a dodgy history. Most lease cars go through B C Auctions and if you know what you are doing there are some very good deals to be had.

I have been at the same auctions as the proprietor and seen how much he bids.
