I wouldn't stake my life on it (I've got a Merc and the specs can be very confusing) but it not a very Active system if it doesn't park itself.

That can't over-ride the law. If it's not as described then the garage is stuffed. Enforcing it might not be straightforward though.

YOU should've checked and made sure you were happy with the car (and its spec) before buying it.

I didn't sign anything other than the finance agreement.

Not upset about the car, i like the car, i was driving a hire one, which is why i went for it and still have the 5 series which is better to drive, but need something for my motor way miles which is why i went for this, and didn't want to buy a car i already have as i thought that would be a bit sad. I can drive third party on small runs, can't afford both.

My insurance is a thousand a yr on this, and £1400 for the bmw. so best for my boyfriend to take my lease really as i can't give it back now.

but i am seriously over miles on the bmw, so my boyfriend has to sell his car, to take over my lease for the remaining year as the 3 series has one yr left on finance on that, so between us we do not need three cars, nor can afford it.
the 3 is not worth keeping because its petrol and done 100k and is 2012.

I was already in st with cars, before buying this one. so was already stressed, because i have completed one yr of lease and 8k over miles because my job changed.
so it was a rushed sale, and i am super pissed off with myself, but i did ask and stress it was important everything was on there, was most concerned about it having blue tooth etc which it does.
But I'm not very good at parking so would have liked the park assist.

My dad did say he would come with me but he has gone away for a few weeks, and i needed something now.

I have it on my Peugeot 308 BlueHDI, was an ex demo vehicle so came fully loaded, used it once in 15 months as its quicker to just reverse in using the parking camera and sensors.

What do you mean by "I can drive third party on small runs, can't afford both."?

And do you really think the answer to going over lease mileage (and paying the extra) is to get yourself in the hock for another £16k?

Why would it have had an MOT at only 12 months old?

One for the dealer people, does Auto Trader pull the specs of cars through when you advertise them? Tht ad looks like a copy and paste from their site as it lists everything.

yes, i would be able to, if my partner holds the main insurance, i could drive it as I'm over 25.
if the cars insured and i have comp on my car then of course i can drive it, if i really wanted to, but I'm not ovally fussed.

no the car has 12k left for one year and he does a lot less miles than me as he drives a van for work, so 1k mileage for him is enough for him to take the lease on.

so it wouldn't be excess mileage if he takes it on.

Exactly.

First test is due three years from first registration. Yet somebody MOTd this at one year, last March.

Now, it may be pure coincidence that a lot of local authorities require earlier/more frequent testing for taxis... Still, it's not as if it's the type of car that just screams "taxi", is it?

That's a Government thing - taxis have to be MOT'd at 1 year. And ambulances and playbuses.

I wonder if it has to be renewed if it's no longer a taxi?

Driving 3rd party vehicles is a very grey area under the circumstances. I think you may struggle with that should you ever need to call on it. The lease company probably wouldn't be too happy, either - I'm sure a lease contract has minimum insurance requirements for any drivers.

But you miss my point - you've just spent £16k of money you don't have to avoid a relatively small additional payment for exceeding your lease mileage. You could probably have negotiated a relatively modest monthly increase to cover it.

No, they said no, i phoned them several times, they will not change the terms, and also not allowed to go over more than 25% otherwise they can end contract early, take the car back, and charge for remaining months.

also i wouldn't be allowed to buy it either.

Actually TooMany2cvs was right - in addition to the Government requirents many LA's require private hire vehicles to be MOT'd too - I just looked at one local to me and they seem to require brand-new vehicles to be MOT'd and then retested every 6 months.
