Disclaimer - I only know from personal experience about what happens if your bike is 'too loud'* not re: kitcars
You are obliged to amend the infringement and attend the centre as with any other construction and use infringement, so the MoT man needs to see the bike fitted with a correctly marked silencer.
Hopefully you'll have kept that in the shed when you fitted the lovely Carbon Cans one

Washing the seize out is merely because it stinks for weeks and its very hard to get the fibres packed densely enough to be of any use if you don't. (they keep springing back up) - It's nothing to do with safety!
As far as Noise limits go, there ARE Construction and Use limits in force!
C&U Regulation 55 deals with noise and lays down the required limits for every different type of car. It refers extensively to the EC Directive on noise (and this obviously changes depending on the age of the vehicle) but the limits vary between about 89 dB(A) and 92dB(A). The important thing, however, is that the Directive measures noise as a "drive-by" test with the car moving and the noise meter much further away than the "static" SVA noise test. It would be practically impossible for the plod to take these measurements as you need a test track with a special surface.

I'm interested in this noise limit thing. I have a Raffo Belva, with a Mondeo 1.8 Zetec engine. Shortly after I got it, the silencer fell off. The thing is, it wasn't particulary noisy (probably because of the cat, I suppose)and I drove it like that for about a fortnight. I've replaced the silencer now, but I wondered if I can just make up a stainless steel pipe without a silencer. Will that work OK??
I would also like to say that I have a bundle of fibreglass exhaust packing and also a bundle of stainless steel packing if its of any use. I bought them for my "7", but never used it. I'd be happy to sell them for a tenner. The stainless steel packing doesn't burn away (I'm told) and gives s better "noise", but you have to put a layer of fibreglass round it to stop it contacting the outer skin of the silencer. I live in Virginia Water, Surrey.

The reason why it’s being discussed here, I suspect, has more to do with track day use than road use. Most tracks have some sort of noise limit. Usually 100 or 103dB.

My exhaust was measured at 110 dB, and they stopped me going around Castle Combe - apparently noone could hear themselves think when I was on track . No problems on the road (even when caught tail out / flat out on a roundabout by a very sympathetic plod )
