So, from next month Which Kit? is going to be renamed Which Kit car?....

Is this a cynical ploy by Peter Filby, or just sound business sense??

Haven't seen WK this month yet. (Purposefully didn't buy it at Stafford yesterday!)

Sounds to me like someone admitting (to themselves at least) defeat.

Make yourself similar to the competition, and hopefully grab a few floating readers whose mates have said "There's an article on XXXXXX in this month's Kit Car magazine....."

Suppose that since I’ve nicked his technical contributor, he feels OK about nicking my name.

On top of the company name thing, I think it’s OOO.

I have to say, this does sound like it's getting very close to passing off...

I believe the law requires for it to be close enough to cause confusion in order for there to be a case. I think there is something about a deliberate intention to cause confusion as well but lets not go into that...

Having had aspirations to build a 7 type kit car to track /sprint, I've finally bought a part built SPD7 that I'm truly delighted with it and the challenge to get it on the road.

However I've been following the slanging match in this forum about 'Which Kit' vs. 'Kit car' mags - and its getting boring. I'm not a regular subscriber to either mag - but you know what? I could'nt care a toss on what mag has the most pages - I buy (or not) based on checking out the articles first in W.S. Smith's mag stand - if i see an article that's interesting to ME then I probably buy the mag. I certainly don't base my purchase decision based on the number of pages or ads thats either mag has. IMHO both pubs have their merits which is to further the aim of the kit car world which surely both pubs can do without slagging each other off . R.I.P

Disregarding all thats gone before I actually think the name change to 'Which Kit Car' is a sensible one and I'm surprised they hadn't done it years ago.

I often wondered what people thought when they saw a mag entitled 'Which Kit' - it could mean anything, so a name change to 'Which Kit Car' makes sense to me as it makes it quite clear what the magazine is about.

They just need to get their act together now and provide constructive and impartial journalism as the title 'Which Kit Car' implies that it will come up with some sort of recommendation based on facts.

Very briefly (and carefully, Ted ).
Fib’s was operating Kit Car magazine through an Ltd company in the early 1980’s. That company couldn’t pay its printer and was wound-up. Fib’s set about producing the next issue through another company.

Printer did two things. Firstly he acquired the rights to publish Kit Car from the company’s receiver (in exchange for the debt that was owed to the printer by the company). Secondly he applied to the High Court for an injunction to prevent Fib’s carrying on publishing Kit Car magazine.

The wording on the Court Order was to the effect that the words ‘Kit’ and ‘Car’ could not appear together on the cover of any magazine published by Fib’s.

That’s why Fib’s published ‘Component Car’ initially, then ‘Which Kit?’ latterly.

It expired a few years ago, at which time Which Kit? was clearly market leader.

Time to apply for a new Order, maybe?
