Might be sensible advice but it would appear from this thread that the dealer will be unlikely to foot the bill or provide a refund without a fight.

So, the car isn't covered by any warranty as it was taken out after the fault was found, even if it had been covered.
Perhaps someone can remind me.... The Finger Follower issue.... Didn't the Warranty companies used to worm their way out of it, as it was a "Known" common fault of the Engine ?
Seem to recall loads of threads on it, when I first came on here.

I had an engine go on a cerb when I had a warranty. They paid £0 towards the fix.

Yep, warranty co. have said £0 towards a repair so all liability with the seller.

We all know who looked at it.
In his defence if the engine sound ok during inspection and subsequently let's go then surely he can't be blamed.

Just looked at the pics, should it not have the later style pod lights? Or was that only on the non speed6 ?

Hope you get it all sorted, has the seller mentioned next steps??

Pod lights were an option on the Speed 6. Ticked on my car along with every other option,except steel dash which I assume the 1st owner must not have like since they ticked everything else. Leather everywhere, Lamonte Headlining, Pod Lights, HIDs, AC, DAB Radio with CD Changer, Heated Windscreen, Overmats, Colour coded boot carpet, Wool Carpets, CR Gearbox, 18" Wheels

Hi

My update with ref the new Cerbera.
Despite promises from the dealer, he has failed to refund my deposit, so today I made a claim against him on line to the Small Claims Court. He has 14 days to respond to the Court, so we will see what happens.

I believe David has also had no response with regard to the engine problem!

Because I didn't end up buying the car it means I have now been able to purchase a Tuscan race car for my collection so I am not to upset!

whos tuscan did you buy? they are becomning quite the sought after car at the moment. Are you going to race it?

Sorry to hear the problems you've both had

I remember looking at the adverts for this car when it was for sale with the original owner as a privite sale when I was looking for my 2nd Cerb. The car then moved around a bit from memory between dealers.

I'm sure this dealer you've bought the car from has been bust before, didnt they used to trade under Driven Image before???

I can't say yet which Tuscan I have purchased, Its a Historick car and has not been on the race circuit for some time! Ref am I going to race it! No is the answer I am going to preserve it as well as show it!

The gulf Tuscan? I remember that one nearly came out a couple of years ago but then stayed quiet. That's a big shame if you're keeping it as a show piece. There aren't very many of them, and the fun of seeing a Tuscan is seeing it moving... You can always mend it of you bend it!

Hi

No its not the Gulf Tuscan!

The car has not turned a wheel for some time and is a race winning car back in the hayday of Tuscan Racing back in the late 90's.
So it's now going to be desplayed to people in the configaration of a 90's Tuscan race car, instead of sitting in the back of a workshop gathering dust etc!

The saga continues:

- The warranty company informed me formally that they have cancelled the warranty as they haven't recieved payment from the dealer (not that it was any use in this case anyway), means I'm owed even more!
- All formal letters ignored by the dealer, the director listed at companies house (not the same as the dealer, but listed at the same address) and the company itself
- civil action therefore now underway against the company and director
- I'm advised the circumstances are likely to result in criminal action as well so the case has been referred to Trading Standards as the first part of this process
- Having given the dealer every opportunity to propose a way forward the engine is with TVR Power. I'm currently awaiting details of the work needed to repair
- It transpires the catalytic converters have melted inside and the heat burnt the chaissis too

Will be a long road, but hoping to get a great car in the end!
