trouble with the noise argument is "have you got cats fitted?" Whoops.

I think that's maybe what they were initially trying to get at. But I do have cats fitted (would've thought all the fuel popping in the near vicinity's probably ruined them, but it flew through its emissions test).

There is no legal noise limit for cars ! There is one for bikes, and as far as I'm aware it's part of the MOT for a bike (any bikers on here confirm ?). Cars only get measured at track days !

I did ask them if there was a dB level that I should have my car checked against, and got told it wasn't about that, it was that it would count as noise pollution if someone in the apartments in the town centre complained. I'm going to a *lot* of trouble looking up all the laws on this via the DTI, etc. and I can't find anything about cars, unless they count as "pleasure craft"

As far as I'm concerned, they'd decided I was going to get done for something, and trying to (very politely) question them just upset them. Guess it serves me right for driving around town, rather than having some fun out on open roads!

But the SVA rules and the 'law' as applied by plod are surely two different things?

If the same officer pulls our friend over next time and states that he has his doubts over whether or not the Cerb will pass the SVA crash test, what's our man supposed to say; "OK I'll bring it down to your station and crash it to prove that it does"?!

Surely the police are there to enforce the rules of the road, not the constraints of car design for vehicles which may be used on the road?

The fine wasn't for the noise, it was for alleged
illegal parking.... and where J S G stopped is where
they had pulled him into - can't be right?

That's the legal issue at stake.

To me it sounds as far fetched as them saying,
"if we told you to jump in a fire would you?"

Go create some weather...

[lots of interesting stuff on the law]

Cheers for that, looks like I've not been looking in quite the right places. I might get in touch with the DVLA and see if I can get it tested... I'd better hurry up though, as I'll be having a sports exhaust fitted fairly soon.

As they let me off on the noise in the end, I guess I can't do much about that side of it. I'm more irate about getting the fine for how/where I parked it. The amount of modified Saxos, bikes, etc. around there kind of justifies stopping people to check in my mind.

Will be taking a trip down to the same place tomorrow night with a camera if I get a chance (also, in the less conspicuous 206). Would dearly love a couple of shots of them parking equally badly, and forcing people to break the law.

[edited 'cos I used angled brackets which messed it up]
