Hi any info greatly received i bought a Vantage at the end of Feb that i found on autotrader payed 500 deposit and agreed to pick the car up 1st April guy emailed last night saying bigger offer on the table and deals of can he do this i did not get a receipt thanks

Sorry but with no proof of deposit I think you may be snookered.....I would get the money back and continue the search....it may be a case of not meant to be.....so could lead on to a better find....

I assume private seller? If so no receipt so your word against the seller?

If it were me I'd just get the deposit back and walk away, I wouldn't care what the car was.

I wouldn't want to deal with somebody who pulled stunts like that. A mans handshake should be enough, there are too many shysters about these days.

As for the deposit, I'd be pretty stunned if he won't just give it back as it's he who is breaking the agreement. If he refuses to (based on what I don't know) then I would actually contact the police. Providing you did a bank transfer then it's simple enough to check, and I'm pretty sure just a sniff of that would get him to give it back.

You agreed to buy a car from a private seller. Paid a £500 deposit and arranged to pick the car up three months later?

Thats a very strange way to interact with a private seller.

Agreed it seems strange, but I guess providing the buyer and seller agreed then fair enough.....odd though it may be.

I think your £500, assuming you can prove you have paid it, is thought of as 'consideration' and legally the guy can not back out of the deal, but it may be a pain in the bum and cost you more than £500 to prove.

I'd get the deposit and walk. Not the car for you, simple as that.

yes if I was the seller I wouldn't have taken the deposit and them waited 3 months to sell the car frown

Quite, three months is a long time for the car to deteriorate, crash, or cause a reasonably hefty storage cost. I think it also strains the trust issue to breaking point between two relative strangers.

I'd feel okay doing this with a dealer possibly, but to decide to buy from a stranger then leave him to look after the car for an extende period is very strange. Thats a massive favour he's doing you by looking after the car.

I would see a deposit as a promise to buy at the earliest opportunity that funds could be transfered. I wouldn't see it as securing three months of car care.

I'm not sure I would call him a 'bad seller' for getting exasperated with the situation. Is there more to this op?

I left the car until the salt finished spoke to him a week ago and everything was ok as he works offshore he was happy for the car to sit in his shed

He simply got a better offer to sell it sooner after he realised he was going to have to wait 3 months to get paid wink

its a slightly odd deal......how did you pay the £500 ? do you have emails from him confirming the deal and your payment ?
