If you have a passenger sitting on the parcel shelf of a V8V, what law are they breaking, and who is legally liable (driver or that passenger)?

They aren't breaking any law but as you have dismembered them to fit them in you will be done for murder most horrid

Apart from the fact that they would probably have to have broken their back to fold over and sit on the parcel shelf, I would imagine your insurance would be invalid so I guess legally you would be breaking the law by driving without insurance.

Why don't you call your insurance company and ask them if they would payout for a claim if you have somebody sitting on the parcel shelf. I would love to hear what they say to you. smile

Not sure what this forum is coming to with questions like this? confused

Probably an overloading offence, the car is designed for 2 people, i.e. 1 driver, 1 passenger. And the driver would get the ticket.

Its like having a car that has room for 5 people, driver, front passenger and 3 in the back. If you add a forth in the back, its over loading. The car isn't designed to take another passenger, no seat/seatbelt etc, driver gets the ticket.

Carrying a passenger in a dangerous manner is covered by Sec 40 RTA 1991:
F240A Using vehicle in dangerous condition etc.

A person is guilty of an offence if he uses, or causes or permits another to use, a motor vehicle or trailer on a road when—
(a)the condition of the motor vehicle or trailer, or of its accessories or equipment, or
(b)the purpose for which it is used, or
(c)the number of passengers carried by it, or the manner in which they are carried, or
(d)the weight, position or distribution of its load, or the manner in which it is secured,is such that the use of the motor vehicle or trailer involves a danger of injury to any person.]


Best avoided.

Thank you, Steve.

It was a serious question - sometimes I want to go a couple of miles down to the shops with two passengers and it's tempting to use the parcel shelf. I have small, reckless friends who fit just fine.

My apologies.....you would be better off in that case with some rope and roller skates......
