Indeed but that depends on the umpire's decision. Can't see anything on hot spot but snicko would give him out.

£5 says he will be fined less than £100 and/or given <100 hours of community service.

He's had a life of suffering and abuse, it must be hard to bear the name 'Gary' knowing that its dying out.

Part of a 'one two' punch routine where his parents gave the knockout blow by handing him the second name of 'Eugene'

Poor fellow may be given compensation rather than a fine or other penalty.

Sadly I suspect you will be right.

Could the owner of the car could pursue costs through small claims court if he is prosecuted?

I would think the owners insurance company would pursue costs from the alleged.

Yes. And it's sad but the defence lawyer for the accused can simply show the number of youtube hits and possibly persuade a judge that the jury pool has been poisoned by this "evidence" that was not presented to any potential jury after due process.

Top tip - don't post videos on youtube of "criminal" acts since that may create inescapable prejudice...

Why is everyone carrying on about a bloody jury??

It's not going to be heard by the Crown Court, it's a summary offence. Could you imagine how much slower (if possible) the court system would be if every offence was heard by a jury??

The images of the accused were released by police (and other sources) as the accused was unknown and his 'assistance' was required to see if he could provide any information in regard to the offence.

I believe it was published first on the Evening Standard website...they've now pixelated his face!

It didn't sound much like how I'd expect a keying to sound.
I agree he did it, and I hope he gets a whacking great fine, but I was trying to play devils advocate because these things often play out differently to what is expected.

You can clearly see him extract keys. Not something but a set of keys. You can also see the keys make contact with the car and hear the scraping noise. Bang to rights

You can't see the key make contact. You know what happened. I know what happened. We ALL know what happened, but in terms of the camera capturing a key making contact with the car, it doesn't show that and I'm fairly sure his solicitor will be making quite a big thing of that.

Absolutely, in my eye's you can clearly see the key touch the car. To back this up and
even more distinct, you hear the noise as he runs it down the side of the car, no brainer,open and shut case!!!!!

I guess when someone does this to a car, particularity an Aston Martin, we all take it personally,certainly I do, there for the grace of god and all that etc.

I've watched it again and you definitely do not see the key make contact with the car, but please feel free to post the exact frame where you claim you can.

It's a physical impossibilty for the camera to see down the side of the car.

As I said, we all know what happened, but I would imagine a solicitor would argue the point that you don't see any contact.
