Oil / brake service on my 'new' Approved Used car,who pays?

Hi guys, there seems to be a lot of knowledge on these forums, can anyone clear up a Q I have?
I bought an Approved Used 3-series from a (non-local) BMW dealer about three weeks ago. I got a pretty good deal on it but the condition based servicing system has just popped up saying the car is due an oil and brake fluid change which I understand will cost me about £250 quid if done by a BMW service center! The dealer hasn't returned my calls yet. Does anyone know whether the dealer should have covered this off before he sold me the car, or whether I've got a good case to ask him to cover the cost retrospectively? Cheers.

Only BMWs which have been maintained in strict adherence to BMW servicing recommendations can qualify as Approved Used BMWs. In addition, any BMW with a service due within 4,000 miles or displaying less than three service interval lights has the appropriate service carried out prior to delivery. The only exception is where the vehicle has the benefit of a service package where the requirement is reduced to 1,000 miles or one service light.

Thanks, sounds like I've got a case. I don't know whether the "service due within 4000" miles will apply to either the brake fluid (which is done when the car is 24 months old) or oil (which I believe is monitored continuously rather than needing changing every x000 miles?), but I'll find out...
