30mph side on into a car
Discussion
So, I've got a court case coming up soon and the guy that pulled out in front of me is claiming i was doing 30+ mph at point of impact.
How often would you say a biker and bike would come away without damage/personal injury from a crash at this speed?
I'd have thought i would have ended up over the bars, maybe broken legs if they caught the bars on the way over? and bike forks bent horrifically/dinged front wheel etc
Thanks

It may not be a bad thing the driver is making claims such as that, as they're quite easy to argue.
Bike damage wise I'd probably expect to see the forks quite badly bent, front wheel and tyre fked, lock stops snapped/damaged maybe, plus obviously panel damage etc.
Personal injury wise you could get flung over the bars, could break wrists if holding on at impact, all sorts.
From the sounds of it the above didn't happen to you or the bike?
It might be worth getting one of these bike/motoring specific legal aids.

insurance are sending someone along to help on the day i believe (barrister (‘Counsel’). (NOTE: this was also whilst traveling towards a red pedestrian crossing light with ped's crossing) and i would have had roughly 12 feet to stop).
I'm going to measure the distance from the junction (point of impact) to where the light controlled pedestrian crossing is.

I actually didn't come off the bike, i stayed upright but the bike did end up on the side. I then carried on with my ride to work as neither i or the bike was damaged. Hopefully the judge will believe this.
Why is this going to court if there was no damage or PI - is he trying to claim from your insurance for the panel damage to the car?If that's the case he's not really onto much as you would be the party established on the road.
just tell the truth! strange as it sounds, apparently the done thing nowadays is to fking lie though to be believed! making up st or explanations as to what happened etc could be your undoing. you will be in court on the spot light and any lie you have told that isnt true or is a fabrication of the truth could and probably will quickly snowball.
you are going to be infront of a defense lawyer whos job is to tear you to shreads, if he thinks your lying to trying to fabricate the truth he will pounce and tear you a new one if he is any good.
if you were traveling at 30 then you have nothing to worry about, he has pulled out I assume he is getting charged.

Here you go - 45 km/h (30mph-ish) crash test. You're not walking away from that uninjured.

note i was filtering at the time. (i would never filter above 15mph regardless)
your title says 30 mph into the side of the caryou then tell us its filtering
you then say you dont filter above 15 mph
this is the kind of st that will see you as easy meat
you can practice a lie all you want till you're blue in the face, go over and over what happened get people to ask you questions but in the spotlight with one fired at you that you havent rehearsed will be different, people give signs away when they lie, police(apparently) lawyers and judges are trained to spot these tell the truth.

He's not saying he was doing 30, the guy in the car was. the title of the thread was a typo and i was unable to edit it.
At end of the day I am going to be telling exactly what happened from my point of view. I have no witness, The claimant does. So from my point of view, the claimant and his company car insurance clearly believe the blame lies with me hence the claim for damages.
Loon,
Are you happy to accept a short/brief PM to more clearly explain the situation?
Thanks

He's not saying he was doing 30, the guy in the car was. anyway this is far too vague to go on, questions like why have you no witnesses you were filtering past cars why didnt you get their details etc
if what you state is correct you are in the right, if they are lying your lawyer will instantly ask them how they could tell you were traveling at 30 mph + and why did you pull out if that was the case.
you have little to worry about.
