The problem with the accident is that you obviously suffered a reasonable head injury
Your recolection of events is going to be sketchy at least and to be honest the police and any medical person knows this to be the common case.

Therefore although I can understand your reluctance to make a claim, I wouldn't like the idea that any motorcyclist that suffers a head injury to be unable to claim. I would leave it in the hands of a solicitor to decide as per loons advice.

If the police decide not to prosecute you at the time for speeding, I think its very doubtful they could suddenly reconsider due to a civil case. It would look rather dodgy for them even to try at this stage.

And lastly I would go round the area knocking on doors, and see if there were any witnesses. I did that once for a car crash and ended up finding a witness that I wouldn't otherwise have found.

Even if the Police did prosecute him, that would only go against him to an extent as contributory negligence. Just because someone is speeding does not give the driver the right to pull out on you. If anything it makes it even more important that they don't. I can just see their defence now "I saw him speeding down the road, so I pulled out on him" I reckon it's game over for their defence.

About the only thing that could save them is if you were travelling so fast that the road could've been completely when they set off, but you were so fast that they couldn't have made their manoeuvre before you hit them. That can't have happened as you had time to react and not crash into them.
