A policewoman who repeatedly denied that she was talking on her mobile phone to her lesbian lover when she caused a fatal crash has escaped prosecution. Despite a police investigator saying that Collette Carpenter ‘very likely contributed’ to the accident, the Crown Prosecution Service said there was no evidence she had committed an offence because the phone was on her lap and set to loudspeaker.

Didn't the law change at some point to say that a mobile must be mounted in a cradle in order to make a call?

So, using a hand held device whilst driving? guilty.

Standard of driving fall below the required standard (even if they ignore the fact she was using a hand held device while driving and just class it as hands free)? guilty

They reckon that using a mobile phone is worse than being over the limit - so give use of a mobile phone (unless mounted in a fixed cradle) the same punishment. A 12 month BAN.

That's the only way they'll stop people flaunting the law. fk the 6 points, 100 quid fine - a 12 month ban, your insurance fked for the next 10 years, possible loss of your job? then maybe car drivers will think twice about picking up that phone.

My mobile is Bluetoothed to the van and stays in my pocket; voice commands or buttons on the steering wheel control it. Should I be banned?

It's not an offence to be involved in a crash, any offence would be if you had specifically done something you shouldn't have, or failed to do something you should. Being less than perfect isn't an offence, falling below the reasonable standard expected can be.
