Hi all ,
Hope this is the right section, 3 weeks ago whilst parked outside my daughters gym on a main road a car went past and smashed my mirror off completely and continued driving.
I jaded after them and noticed they had stopped in the distance in a fire station so I pulled alongside and the guy admitted doing it and said really sorry please don't go through insurance so I took his details and said I would check in the morning the damage and look for prices .
Which I did so told his price for a second hand mirror and would fit myself too save him some money he said ok can you wait until end of his month when he gets paid which I stupidly did too nice for my own good.
My car was for sale at the time and had someone interested so paid out of my own pocket too get it repaired.
You know what's coming next
Now the guy is refusing too pay and saying go through insurance but I have since Sold the car where do I stand guys?

Buy a dash cam and move on, unfortunately.

If you've got a receipt for your outlay, issue a small claims court summons (after giving him warning and 7 days to settle). Let him go thru insurance if he wants to.

Did he give you his insurance details or just his personal details? Tell him okay no problem you'll get in touch with his insurance and sort it out that way...you may find he backs down. If he doesn't I'd just leave it.

He just gave me his name and number I know you can ask dvla for address details for cases such as these

That'll give you the registered keeper details but not necessarily his details. Worth trying to get it though. If you get it, you can call round and see if the car is there, then you'll know.

Drop him an invoice through the letterbox, giving him 7 days to pay or a period you consider reasonable.

You could then issue a money claim online using his name and the address if he doesn't pay up.

How much are you owed?

The fact it is fixed won't change the claim (it still happened), it will just be evidencing it.

No doubt he has breached his insurance terms by not notifying them. Ask for insurer details and make contact. See what happens. for the value, they may just settle and weight his premiums.

What happens if he turns up at small claims hearing and says he didn't do it, how can you prove it?

It takes a brave/stupid man to turn up at court and deny that an incident and subsequent conversation took place such as in this case.

Would make a great Judge Judy episode!

OP,

Upon reflection do you have his insurance details? If not, is he refusing to provide them? If so, do you have his reg. no? If you can provide me with the reg and date of accident I can search for his insurance details for you.

Make sure you say everything in the first call, because your number will be blocked from then on.

Asking the at fault parties insurance to pay for the damage doesn't make the OP an idiot does it or am I missing something?

So if someone damaged your car to the tune of £130 they give you grief about not paying when they said they would you'd pay it out of your own pocket?

1) You've already paid for it though and fixed it
2) You have already sold the car so presume the car is no longer under an active insurance policy
3) The increase in premiums over the next 5 years will be far more than £130.

No, I don't - but even a £30 increase per year is enough to tip the balance.

I would not go through insurance for £130..

You would still have to declare it as a non-fault accident at renewal so what do you gain by not claiming?
