Golf R Warranty Help Please

Here's my thoughts...but feel free to tell me I'm wrong and that this is all just a big coincidence.
Mr X bought Golf R.
Mr X allowed his car to be used as the APR development car.
It was running well, even done some runs at Crail on the Revo day. (You can see videos of this car racing Bradley Allans R8).
Turbo died.
MR X had his ECU flashed back to standard.
VW said we can tell that the ECU has been flashed therefore warranty void.
Oh and to top it off I notice you're friends with Mr X on Facebook.
Am I right?

I'd say VW and audi for that matter are super vigilant for denying warranty claims at the moment my car went in with a fault on the haldex (only running fwd, with 340ps quite interesting!) the dealership was asking if had software on the car (standard) head techie said we have to pull the ecu on these to see if it's been tampered with before audi will pay for any driveline claims, best of luck op

Need to know more about the history really, i.e. who had it before. Could it have been a development/ press car of some kind which ended up surplus to requirements hence it was moved on? Or damaged prior to delivery and repaired from bits from a written off remapped car? All sorts of possible explanations (but obviously OPs friend having it remapped themselves would seem the most plausible).

No. Assuming it's under 6 months since car was bought, SOGA says that SELLER must prove that the fault was NOT present at time of sale. After 6 months, burden of proof shifts to buyer.So, if the 'fault' is the TD1 flag, the selling dealer has to prove that the car has been tampered with. Maybe they can prove that the flag was clear in any pre-delivery checks - or hope to find some evidence on social media/PH/forums.

You may get some headway claiming its in here to in the design, but you would almost certainly need a full independent engineers survey, and threaten to go legal.

Either way, this sounds extremely fishy. But it wouldn't be the first time someone's come a cropper modifying a car they don't actually own.

...alternative option; he's making this thread to show how innocent he has been, inferring that whatever TD1 witchcraft must have happened within the delivery miles to 40 mile period. Possibly sharing the link as part of his defence? Although, with the comments, that plan has suffered quite a large setback.

Part of the used car check is a summary of the diagnostics copied off the car and stored. As a buyer you don't normally get this just the report, if you ask , the dealer can give you the print out. I did when I got my last car. Td1 status cannot be removed by the dealer so one assumes once flagged the status stays for the life of the car, with potential impact to trade in etc.Either way, this sounds extremely fishy. As for mileage, now cars may come with upto 15 miles on the clock, if it was a lease car, extra delivery miles to end user could easily take it to 40.
