Well, to finally put this thread to bed...

After the little incident I had last year it seemed those who expected the other party to try for partial liability were right. This ended up going all the way to court.

So Central TVR had the car for repair for 3 months, but when I finally got it back it looked great. They did a fantastic job and I got them to do a couple of extra bits while it was there: 7 inch headlight upgrade, hot start kit fitted.

Every month or so I would hear from the lawyers saying the case was progressing, but basically the other party was claiming I was at fault and were claiming costs against me.

Yesterday it got settled in court. The judge heard from us both and after what can only be described as a joke of a case from the other party he dismissed their case entirely.

It only took 10 months to settle!

Lessons learned: take lots of photos of the accident site with the cars still in place. Get witnesses. Unless it is your fault, in which case man up and bite the bullet and take the hit. There are too many out there who will try and dump it on you given half the chance.

Drive safe.

Congrats Red Baron, so glad it went your way ( As it should rightly have done ) it must have been very stressful for you to have to deal with and thank god you weren't hurt.

If you are involved in an accident Don't believe anything the other driver tells you.

When those 2 scum bags hit me on my R1 head on @ speed on my side of the road in Oct 10, in their Merc, the first words the passenger said to me as I was lying helpless on the Tarmac were " you were on our side of the road".....I knew then that unless there were any witnesses that I was in big trouble.....

As I was laying on the road the woman driver got out and walked towards me, I then passed out and when I woke she had moved her Merc back to the correct side of the road Before the Police and Ambulance arrived.

When the case got to court, the B... arrived over 3 hours late for the hearing ( And I got a parking ticket as a result, which gave me even more agg to get retracted ) she sneered / laughed at me in court and then lied her head off to the 3 judges. I had to relate exactly what happened to me, which was extremely emotional.....

She said " As I stand before de Lord, he jumped off of his "car" before he hit our car"......
One of the Judges had to be held back from laughing......

Thankfully the Only witness ( a young lad who was behind them, turned up at court. The Scum got a £975 fine and 5 points......
The cowboy recovery co ( BJG of Basildon DONT let them recover your vehicle ) had my R1 smelted down and Essex Police incompetence is laughable.
Unfortunately I chose a Cowboy " So called Specialist " no win no fee, biker solicitors " ( who aren't fit to wash dishes ) and was regally shafted by them.
My life has been ruined as a result of that woman's reckless stupidity.

Neutral 3, I'm very sorry to hear your story. It p1sses me off no end that cowards like her do such stuff and then get away with such a lenient punishment.

I am pleased, though, that you are still around to tell your story.

I hope you can make a full physical and emotional recovery.

Will post some photos soon, but am away till the weekend.

They look better in the car than the originals, but I'm not blown away by the difference in light output. It is still like driving at night with a couple of candles up front. Maybe higher output bulbs are required.

If they take H4s, then Osram Nightbreakers in the same wattage give you about an 80% improvement for about £12. When I had one of those blow 80 miles from home all I could find was Ring high output 55/65 bulbs for £25, but claiming 125% improvement. Very surprised to find the claims were true.

Red Barron, the Series 1 E Type suffered very poor lighting due to the glass covers over the head lamps, the covers cause the light to "scatter" this could ? Be the case with the Griff as both cars light arrangements are very similiar.

Well you're driving a fast noisy sports car, so would obviously be speeding, and driving like a maniac...smile

Seriously though.... Sorry to see the damage, but get yourself prepared, photos, write down what happened so you don't forget anything...
Be prepared for her to change her story and try to put the blame on you.... Be prepared for her insurance co to push for 50/50

Be prepared to be without your car for a few months....

Don't give an inch.... You want a full no fault payout, retention on NCB and full refund of your excess...
agree with Quinny look shell change her minbd you were speeding came from nowhere etc etc people just arent honest so if it happened to me i would be taking photos getting her policy asking her to sign a statement and if that failed i would bloody go other extremes. arounbd our way local mainly asians are running insurance scams creating accidents then intimiudation i tell my wife if she gets involved in accident to have neck injury and call ambulance then police have to attend get it
