'The Sheriffs Are Coming' is an excellent programme.

Re court, it may be a clean home run but be ready for any dirty tricks/spanners in works/bleating. For example they could fail to turn up, lose by default, then appeal claiming they never got the hearing date, then in three months' time there's an appeal hearing. Judge: 'Did you get the letter?' Lying scumbag: 'No'. Judge: 'Appeal upheld' and back you go to square one again. Or they could claim they never got the information from you. Judge: 'Did you get the info?' Lying scumbag: 'No'. Judge: 'Case dismissed'. So I hope you used SD.

Oh yes, I have already printed out proof of delivery to both the court and defendant. I know he got it all as I'm good friends with someone who works there, and he saw it on the guys desk.

Not that it counts for anything but I think/hope I have everything covered. You never know, the 3k may fall into my back account next week. Unlikely I know, but you never know.

Well, there is a good result all round.

Dealership called me approx 2 pm, asking would I be prepared to discuss, no problem, lets talk.

Asked how much they owed, I said £3000 plus £420 costs, they offered £1500, told them I want £3420 of I'll be at court at 10am tomorrow am, after 10 mins of discussion they agreed to pay £3420.

Just checked, its been paid into my account by bac's, I presume they can't take it back.

So, many thanks for all the tips and pointers over the last 8 months,PH has once again come up trumps, hopefully this is the end of the whole sorry matter.

Well done, you were 200% right to hold your ground, only benefactor is the customer in this whos had a major result, youve lost a customer, garage has lost £3420!

well done, excellent result!
much better than I faired...its a really stty system...exactly the same as yurs... went on for months, defendant couldnt be cntacted for mediation ect..then when it went to court the first thing the judge said was "before even looking at the evidence would you not be prepared to mediate and come to an amicable settlement"... and no one wants to be the awkward one wanting all their money...
I felt pressured the whole time to accept less money to settle the case..

I seem to recall that the mediation option is encountered before a hearing date is set. The defendant was asked if they wanted to defend some or all of the claim, and rather stupidly chose 'all'. Certainly it was they that chose not to negotiate rather than me.
