Hi,

After some general advice on trademarks. I’ve an interest in using a domain name (let’s say it’s manageproperty.xyz) for a new business. i.e. it’s basically 2 dictionary words that describe perfectly the business we will be in – managing property.

We will only trade in the UK and only in our region of the UK, not a big business.

Should I really worry about trademarks and infringing what someone else has elsewhere in the UK or globally?

I’ve read up a bit and example of Apple selling computers comes up a lot – they are called Apple and don’t sell Apples so their trademark rights are very strong.

My pragmatic thought is to Google for that name and if there's no-one using it, carry on.

If it's entirely descriptive then the chances of someone having it as a trademark are pretty slim.

You can always check on the IPO.gov.uk website to be sure.

hmm. If I search on the IPO site it shows someone in Spain has it registered but with a picture of their logo which contains the words. Google shows a lot of companies trading with that name around the word - maybe not far off something like "manage my property".

You do know trademarks are geographically limited, don't you?

I.e. the Spanish mark (unless it's a "Community Trade Mark") is applicable only in Spain.
