New Business. Now Landlords wants scaffolding at peak time!

Hello,

I own a frozen yogurt shop that is in it's second month of trading. We are in South Devon where the summer holidays are our life, everything happens in these 6 weeks.
This morning I opened my doorto find a letter from the estate agent that manages the property that says from the first week of August there will be scaffolding erected on this building whilst they decorate the outside of the building. The scaffolding will be moved around the building as they de orate the different sections. I have been told by the agent that it will be outside our shop for 2 weeks.
This is unacceptable as this takes up 2 weeks of prime business time for us. We are in the second month of business so every penny counts, this could seriously jeopardise our business.
is there a way I can make this not happen. September would be a fine month for this to take place, August just takes the piss.
We will lose out on big money (for us).
Help would be appreciated.

Acting for retail tenants this is something that we often raise and also get thrown at us when we are acting for landlords. The fact is that the landlord is obliged to redecorate so the only issue is over timing. It may be possible to reschedule but we often have specific provision in leases which address the issue, limiting the time and duration for which scaffolding can be erected.

Unless there is something in your lease then unfortunately you have to rely on the landlord being accommodating.

Impossible to talk top the landlord add they are are big company.
I know they are obliged to redecorate but August is just ridiculous.
I will have to look at the lease tonight when I get home.
I'm posed of because this will wipe a huge chunk of our year.

Talk to the landlord about altering the programme, so that the scaffolding outside your shop is erected at a better time for you.

Also, ask the landlord to arrange for temporary signage to be placed on the scaffolding, which will help with letting customers know that you are still open trading behind the scaffolding.

You say the scaffolding is moving around, that sort of implies a tower rather than the whole building being covered. So you may not get any joy out of your landlord as they may think a tower is as accommodating as they can get.

So use it as a marketing opportunity, banners as suggested above. How about "repainting / scaffolding special buy two adult drinks and up to two kids go free". Or "Bob the painter likes our iced yoghurt, see if he's right". I'm sure you can think of others.
