Playing around on riskdisk and decided to credit check one of the company's I'm a director of, only to find that I get the option of a new company I have not seen before, We are 'Halo Lasers Ltd' & they are 'Halo Laser Services Ltd" looking at the rules of naming companies these seems a no-no but still companies house has allowed it, I cant find much about our new namesake other that its probably a Husband/Wife outfit and the wife is a barrister. I doubt it will ever cause any real problems but I would rather get it sorted sooner rather than later but I don't know who I should contact, Companies House was not very helpful, the lady I spoke didn't seem to understand the issue. Has anyone had any experience of this type of thing before, to be honest if I hadn't looked I would probably never found out about them and they might disappear in a year or so, but i do know and its bugging me a bit.

"Services" isn't one of the words that is dropped when comparing two company names to see if they are "same as", so technically there is no problem with registering that as a company name. See https://www.gov.uk/government/uploads/system/uploa...

The best you can do is keep an eye on them, depending on what they do you might have grounds to say they are "passing off" as your company.

Alternatively, get in touch with them, see what their intentions are, have a friendly chat, there might not be anything to worry about.

Companies house has no links to the Intellectual Property Office so as long as a name is available, it can be registered.

The question for you is:

Is the new company intending to engage in the same field as you? If so, you could defintely pursue them for passing off whereby a company is creating confusion on the part of the public by using a name that is the same or confusingly similar to that of an existing business.

First thing i would do would before talking to the offending company would be to start adding the TM symbol on your website denoting you are using the name as a trademark and then perhaps get your trademark properly registered so you can use the ® symbol.
