Got this nice letter today from HMRC:




Ive always been under the impression i had up to (and including) the 5th of the month to do this?

Ive checked and all where submitted on either the 4th or 5th of the month.

In fact, ive pretty much always done the submission on either the 4th or 5th of the month, so not sure why ive all of a sudden got 3 infractions in one quarter?

Has something changed?

If it has changed, i guess im going to get fined for July and August as well!!


Anyone any ideas?

You need to do your RTI submission on or before your pay date and then pay HMRC by the 22nd of the following month.

Ive always set the pay date as the last of the month, do the online return by the 5th, and pay on the 22nd.


Looking at hmrc site, it does indeed say to pay before pr on the pay day!

Not sure where ive got the 5th from then?

Also how come ive not had a penalty before in the last 3 years?

I now just sit down once a month and take care of the whole payroll.... Pay employees, submit the RTI information, and then pay HMRC through their website.

Otherwise I'd end up forgetting to do something and I'd be getting letters too!

The 5th is the last day you can make the payment without it falling into the following month, but if you aren't sending the RTI information on the same date as the payment they'll say it's late.

Looks like you got the first one free (did you not get an email about late submission - make sure you sign up) and I think you will get a penalty for each month frown They have been quite relaxed about it since introduction but I did read that this year they were going to start tightening up on it.

Still, it's got to be worth a call to HMRC to see if they'll waive it, you never know!

I fell foul of this about a year ago and that turned out to be being two or three days late with the RTI submission. Fined £200.
We were leaving off on a Friday and I would do the wages for the last week first thing Monday morning and do the RTI then.
Wrong.!
Do the wages on the Friday and the RTI as well.
Sent an appealing letter to admit my ignorance. Result . Got my £200 quid back.

The rules on RTI caught quite a few people out when they were first introduced. Although the PAYE month always ends on the 5th, the filing date for RTI is ALWAYS the date on which the payroll is actually run.

Thanks, looks like I'm guilty then frown Looks like i will be in for a £400 fine!!

Its a shame they don't notify you straight away so you can change your ways earlier...

I guess nothing lost by trying an appeal.


But what i don't understand is why only since april have i started getting these penalty's?

Also how early before end of the month can i submit? To save me forgetting on the last day of the month.

As long as you submit your RTI on or before the actual date the employees are paid it can be any date in the month in advance. Firget the 5th in this context, it is just the date the tax month ends - only affects timing of declaring for weekly pay periods not monthly.

Well a little update.

I sent an appeal by post, but had no reply so assumed the appeal was declined.


Just logged onto my HRMC login to check my Paye bill, and the fine has been removed!

So can only assume they agreed to the appeal?
