It's an expensive thin piece of metal for god's sake... you can hardly blame it on the manufacturer.
If I were to sit on my £500 pair of glasses and they bent (which they would) should I go back to Oliver Peoples and ask them to replace them? No.

even if there are a few hundred people with an issue, they've sold millions. If it's turned round a bit in your pocket, you can feel then tension over it when you bend your legs to sit or tie your shoes or whatever... it's obvious when your putting a force across it. Just fking don't do that, surely? Also if you sit on it in your back pocket, you're a fking neanderthal that deserves only a tin can and some string.

My 4s does it between 25 and 30bcan catch you if guard the first time but I soon learned to calculate it in. Maybe the percentage / sensor is less accurate.
