There is a forum which seems highly necessary called Smart Motorways Kill. Our Toyota Land Cruiser went faulty on the M1 near Tibshelf and at the time a barrier prevented the immediate stop so the engine had to be kept going for a further 5 minutes.
After that time thankfully a grass verge was used to park on, well away from lane one. Incredibly the lanes were operational an hour after I stopped.
Two operatives confirmed by email I had stopped /broken down in a live lane.
It is apparent that when a vehicle is reported that it is broken down in a live lane a STAT is issued and an enforced removal is put in place.
Due to the proven facts of the matter by dash cam this puts NH in a circumstance that renders them to be guilty of demanding money by false pretenses. If a chargeback is carried out by the bank who paid the enforced £192 to be shifted a mile then it is I am told the onus to prove receiving
the payment was valid and lawful? It seems unusual that if the demand for payment is not met, the vehicle is seized and 'disposed of' in 14 days....
Aren't 'they' making enough out of the speed cams on motorways..... It has been said 'they' are not making any profit from their over the top lawful legislation?

You broke down on a live motorway, NH followed their procedures to remove the vehicle and charged you for the privilege and you feel it is false pretence because your assessment was that it was safe? My view is that it's a risk of driving on any motorway and risk of motoring - there are potential costs from any motoring from chipped/cracked windscreens, nails in tyres, hitting animals that run out, parking dents etc.
Move to certain European countries and the cost of being removed from the Autobahn/motorways can be €600.

To the OP, if you take any notice of the news you will see that only yesterday someone lost their life on the M1 near Leicester. That started with a broken down car on the 'safety' of the hard shoulder but still ended up in a tragic accident where a pedestrian from that car ended up being struck by an HGV.
And you're moaning that Highways England had you and your car removed to safety from the grass on the side of the M1 and it cost you £192. It could have cost you a lot more, like that fella yesterday.

Go back a couple of years and not a week went by on here without a thread being started about Smart motorways, their dislike of them, a story from the news tenuously linked, etc, but i think the mods got bored of closing them / linking to an older / existing thread and just started deleting them outright

Oh god I remember the OP. For anybody that's not familiar, and can't make head nor tail of this particular post, bear in mind that in a previous thread he complained bitterly that he got done for towing a boat in lane 3 of the motorway at 60mph past stationary traffic in lanes 1 and 2. This made the coppers 'overzealous' and 'avaricious' apparently
