Hi all,

I know this has been covered plenty of times before, and I did search but I couldn't find anything relative to my issue.

So at the start of Dec I bought a 2008 Audi A4 TDI from Car Giant. I've bought from them before and I know it's pretty much sold as seen, but here's the thing. If you're at CG, you have the keys to the car for about 30 mins max. Hardly enough time to check the whole car in detail.

I managed to check the basics and the key issues and I bought it. However, since then the car has developed fault after fault. Turns out all 4 brakes were gone and need replacing. Then turns out that the exhaust mount and gearbox mounts were rusted and needed replacing.

I gave the car back to CG and they have agreed to carry out the work for me for free, but the thing is they are taking FOREVER. They ordered the parts a week ago and apparently they won't arrive for another week. Frankly, I need my car and can't be without it for over 3 weeks while I'm working 60 miles away. As the parts havent arrived yet I have told them to hold on for one day while I see what I want to do.

My question is, under the SOGA can I request them to take the car back and give me my money? Whilst on the motorway in the audi I lost majority of braking and the whole car started juddering @ about 80MPH.. Making it very unstable to drive.

I don't particularly trust them with my car to do the repairs, and I have no desire to wait over 3 weeks for them to get it back to me. What can I do?

page 28 has a flow chart with your rights

I think you are unlikely to be able to go do the route of a full rejection having had the car for a month, and even if you have returned the car or contacted them regarding issues within the first week or so, i'm not sure worn brake pads and rusted mounts are major enough to reject over anyway, hard to tell when you just say the brakes are gone, that could mean they need new pads, which isn't even really a fault, it's a service item or you need 4 new callipers. An exhaust mount certainly isn't a major fault, nor I doubt is a gearbox mount.

You do however have the right to compensation for any predictable costs resulting from being supplied with a faulty vehicle, this aught to include the cost of a temporary replacement should you need one, but to stand any chance of being able to claim that, you would need to request a curtsey car and have that request refused. They know this, so will almost always give you one if requested, as it costs them nothing, they've got stacks of similar cars gathering dust.

from my understanding they are offering to complete the work and its the first time its gone back for it to resolved so there isn't really much you can do.

Ask for a courtesy car to be provided for the duration of the repair and wait it out

Got a courtesy car given (Meriva) Drives like an old tractor!

I suppose you are all right - I just got a call from them saying that they have found rust on the underside of the car which caused the mounts to wear quickly.

They also said the Brakes require complete replacement, so Pads and Discs to be replaced.

Fair enough they are correcting the work - However I think I would rather sell the car on and get something in better nick. This already sounds like it's going to cause me a lot of issues.

Heard of a mounting bracket that's part of the exhaust rusting, but never, in 30+ years of motoring gearbox mounts being so rusty they needed changing - very odd IMHO.

Don't panic, you can use your company car now whilst they take however long they need to repair it.
