My OH is a hairdresser and beauty therapist, and has always worked full-time employed, however she has been approached by another salon, who have offered her a commission-only role.

We're both slightly confused by this as they have clarified they are offering her a "commission-only role, still employed by the salon, and on PAYE".

My understanding is that you are either -

a) employed by the company and as such are entitled to annual holiday, minimum wage etc or
b) you are self-employed, and thus can set your own hours of work, set your own holidays, pay your own tax, and have no entitlement to minimum wage.

What it seems they are offering is a mix, whereby she is employed as an employee by the company and pays tax and NI through PAYE, yet is not entitled to set her own hours of work, set her own holidays, or take a minimum wage.

As such i think she's just going to knock it on the head, but it got me wondering, is this a legit thing to actually offer?

No, it's not a legit offering. They're obliged to pay her minimum wage, and holiday pay etc. She wouldn't qualify as self-employed if she can't set her own hours etc. Very iffy.

Sounds like they are taking the piss, unless she was desperate I wouldn't touch it with a bargepole.

Indeed, though, if she's easily amused and can afford to, it would be a beautiful way to head straight into an employment tribunal fairly quickly...

Well, I think that would be some more information on exactly what was being offered. I think that if I had been offered a commission-only role I would have asked for more information from the person doing the offering.
