ok, listen up.

I am going to war on Tuesday. Incase you didn't know, I have what looks like a cast iron mitigation case against ***** Police.

So confident am I, that I expect to be invoicing them for damages/costs !

What can I claim for? time off work, stress, what exactly? I want to make this one sting.

Got the gatso certificates yesterday, I wanted to summon the guy in the van, but it is too late - their fault !! I'm gonna make 'em pay for that one too.

Got the photos, and they back up my mitigation ! so what can I extract from them????

Obv. if I lose, I'll be an unhappy chappy for a while.. but they have no witness apart from the photos, and they can be interpreted several ways. They also show a 2nd vehicle in the shot which I beleive contravenes operatating procedure. Hopefully I won't need to get technical on them, but I have 3 shots in this gun !! (oo-err!)

Wish me luck peeps, and think of some good things to itemise.

I think what you mean is that you have 'A DEFENCE'

For Gods sake dont go into court and start mittigating if you think you are not guilty.

PLEAD NOT GUILTY and argue your case.

IF FOUND GUILTY THEN PLEAD YOUR MITTIGATION

(commonly known as a**e licking by lawyers to reduce the sentence, i.e you didnt get a birthday present from your long lost second removed third hand sea faring uncle when you were six and it has been a blight on your childhood and formative years, culminating in a momentary lapse of concentration when the albums of your memory stirred your emotions to the point where your vision was obscured by the welling of tears and you failed to see the safety camera, Yellow coated Police Officer as a result.)

A twitch of the head occasionally with a small amount of dribble running down your chin may help even further.

For that advice stick a fiver in the benevolent fund box next time you get a provisional FPT

ok - maybe wrong word. I am pleading "not guilty", and giving my reasons why. I thought it was called "mitigation".

Still, don't care too much, 'cos I am going there to win. But thanks anyway.

I have the mit-reason why I did it.

I have evidence of improper use of the cam. Their own photo shows an oncoming vehicle in the radar cone.

The van was not legally entitled to be there, so far as I can tell. Eg, not a blackspot, and not marked correctly.

Unfortunately I can't get a camera in there !

No, I'm still here - trying to calm down after the fu*kwit judge adjourned the case rather than dismissing it. CPS fu*ked up, and the whole admistration of my case is shot. They don't know how to proceed, so I had to wait 4 hours to learn this lot.

I have written to CPS complaining of the waste of time, and suggested they drop it or be embarrassed when they eventually lose, 'cos I also promised that if I get a fine+points, I will be back when article 6 is approved !!!

The legal system is crumbling, just like everything else in this country. The thin blue line is stretched to breaking point, and the court system is broken.

The only way of enforcing law is with robots (spy cameras), and soon you'll be able to drive drunk or dangerously provided you don't speed. All because there will be no coppers left, I imagine they will all be disillusioned.

Old Beak was an arrogant man, with 2 decent people. Arrogant bloke spoke, and I argued with him. Had to stop before I got "contempt of court" !

I WILL NOT give up, I am going to win, or I will have to consider quitting the country.

I thought it was just me that had these views. Since Tony and his cronies have had their hands at the helm it has got twice as bad it ever was under the Tories.

I dont think they would have grounds on contempt of court as long as you argue constructively and don't become abusive or show your frustration to them. It is much better to remain calm and then explode in the foyer at CPS reps.

A bit drastic hertsbiker but I understand where you are coming from.
I unfortunately just broke into the 40% income tax bracket last year by about £400. I just received a tax assessment form to fill in. My wife doesnt work so all the savings accounts are in her name as she is not tax liable.

Made the mistake of having one small joint savings account which made a net profit on interest of 98 pence.
I am liable to half that being 49 pence which was taxed at the normal rate. They want the extra 15% tax off the 49 pence. I tried to explain that it would be more expensive in postage than the amount I owed.

THEY WANT IT

That will go considerably to assist in the up keep of several assylum seekers then!

Not quite true, everybody is liable to tax, including a newly-born baby. However the 'tax-free allowance' also applies to everybody which means that only people who have an income greater than the allowance (I'm not sure what it is currently, £4-5,000 I think) pay any tax.

You're supposed to round down any income to the nearest pound and round up tax paid already... so on 49p that's 0p income and £1 tax paid already so that would mean that they owe you money!!

It's their rules!!!!

Keep up the good work. Good luck in the case, but I have to concur with your opinions and views about the legal / police situation in the UK now. Its a joke, I have said it before and will probably say it many times again - we are in a time where money talks..... If you have it you can get away with almost anything. Shame as for the likes of us all - we dont have nearly enough.

I am starting to get increasingly disillusioned by the whole legal process. The number of guilty people that are let off or given low sentences is just daft..... You have people who steal mobile phones getting 2 years and (if you saw the BBC2 documentary last night) paedophiles with 25 years of systematic abuse (including rape, indecent assault, taking and distributing photos and videos) getting 6... what the fcuk? It is really hit and miss - and this is no longer acceptable.

I do actually have a lot of sympathy for the police as they cant do anything right. The public expects everything from them and the government pushes stupid regulations there way.... joke....

Long may the fight continue and good luck. Let us know how it goes and lets hope you win - and this is the scary bit - it all depends on the judge!

Paid my PAYE for the year (I'm a normal employee for a corporate) and filled in my Tax return at the end of the year (Including some income from "other interests") works out I owe them £37,849.12. They send me a letter agreeing to the calculations so I send them a check for the above amount (crying whilst I wrote it). I got a letter a few weeks back saying they had 'revisited' my account and the calculations were incorrect and I should have paid them £37,849.13. Dire warnings of being sued etc unless I sent them the outstanding 1p within 14 days.

Sent a cheque in the prepaid envelope (along with a with compliments slip made from brass by the local forge and weighing over a 1lb).

Cost em 22 quid in postage.

Well, I've been to court twice for pre-trial hearings & both times the CPS have requested 6 week adjournments because they haven't managed to get their shit together. Both times I've had 'no further action' letters the day before the adjourned court date.

The CPS don't have the time, money or staff to spend in piddling cases like yours (or mine) so they'll drop it like a stone unless they've ot something concrete and a staffer who can handle it..

Absolutely brilliant! , got to remember that one next time I get junk mail (I usually do return to sender on it, and hope it costs them - normally credit cards, including one invite to apply for a card from my current credit card company - for the same bloody card!!!)
