got a parking fine i didn't know i had....no ticket on screen etc....have asked for photographic evidence but they cannot provide it , and are still insisting i cough up the £130.00.....any idea's on where i stand?....i always thought photographic evidence was required now by law , and so why the parking taliban now all carry digital camera's.....

Is it from a council? If not, don't pay it.

If they have no photographic evidence then you can appeal under the heading 'The contravention did not occur'. If the council will not allow the appeal you can then go to PATAS and they will throw it out if they have no evidence to back it up.

Trust me, when parked in the getaway car many have tried, but if the ticket is not applied to the car then tough....

Seriously though they need to prove it and that is that.

The law has changed recently so that the registered keeper can be pursued rather than the driver (who you were not compelled to name; S172 did not apply as not police sanctioned); this was the compromise to ban wheel clamping. But it has yet to happen...

If they can't provide photographic evidence... they certainly aren't going to pursue you to court as they can't prove anything to them either!

File in the bin unless they can show you it is you. Could be a scam.

You can challenge it or is it already too late? Can't see how they can proceed without any evidence whatsoever.

Post something up on Pepipoo, they can advise better than us.

I'd appeal it and if they've told you that they have no evidence of the offence, I wouldn't pay.
Keep copies of everything though...

When they send the PCN through, there is an appeals procedure. Just follow the letter and appeal.

In the old days, before digital photography and car tax databases, they used to take a note of the tax disc serial number and used that as evidence. In fact, when I received a ticket 3 years ago, I recall the parking attendant taking a photo of the tax disc as well as the car.

i have appealed it...they have turned down appeal....now sending off another form they sent me....still insisting on evidence and photographs...

Just can't see how they can prove anything; or do they have photos, they just won't send them to you?

Otherwise surely the burden of proof is on them?

These parking attendants are like vultures, i certainly wouldn't pay out without any photographic evidence or location/time/date!

You could be an ar*e and say none of croydons parking bays conform with Traffic Signs Regulations and General Directions (TSRGD) 2002 biggrin (especially if they do provide photo's!).

Had a similar experience in Croydon recently. I did challenge the PCN. Failed to convince, but as mentioned in previous posts, appeals documents are issued, in my case a picture was enclosed.

I felt that on the balance, and Croydon’s seeming hatred of all things wheeled and the possible financial penalties that could be levied if unsuccessful I opted to pay the reduced fine.

As an aside, part of what has become the majority party of Croydon Council election manifesto was to stop future instalations of raised surfaces as a traffic calming measure. It would seem the use of over zealous traffic enforcement being the alternative.
