Agreed a lease - car no longer available!
Discussion
Hi, I have an issue for which I need some advice on please!
I negotiated a personal lease on a new Fiesta Zetec S 1.0 Ecoboost for £155pm on a 6+35 deal on Saturday direct with Ford, for a black model with the standard 16" alloys. I need it relatively fast, and the only stock vehicles available have the 17" alloys which Ford will not negotiate on. I don't want to pay any more than £160pm, so when I was told that there was one car available in my spec, I paid the £250 deposit and signed the order form at the dealer. I was told the car would be available as soon as the finance company had processed the forms.
Today I received a call saying that the car is no longer available and that it was taken before the dealer processed the administration. I'm not at all happy with this, as they cannot now get me the car I want unless I wait up to a month. They won't budge on the £300 for the 17" alloys at all. They have my £250, and I still want a standard car, but where do I stand regarding this order?

The dealer is obliged to refund a deposit, that is all. Unless of course you are able to demonstrate actual losses and are happy to persue through small claims?
They don't have a magic wand, if the car isn't available then either have something that is (and stump up for the alloys), or wait. It sucks, but its tough luck really.
If you are lucky you may get some kind of good will from the dealer, but on a skinny deal like that I doubt it!
