All,

Need some advice.

We currently have a service being provided by company A.
The service is not particularly good and we are looking to go out to tender for including Company B, Company C & Company D.

Now, Company A have come back to us stating that one of their staff members dedicates over 50% of their time to our account but is not fully dedicated. This staff member is a cause for some of the poor service we have received however we respect the laws and have to take this TUPE highlight very seriously.

We would like to consider using Company B, C or D but are attempting to understand what the TUPE thresholds are.

We have also put this to our HR and Legal folk and are awaiting suitable responses.

Look forward to hearing the PH collective view, especially from people in the know.

It is quite a bit more complex than just % of time devoted to you, for example an account manager would be out of scope! Best to let the lawyers deal with this.

Love it! "We have lawyers and HR people, but I'll throw this one open to any random person on a motoring forum." Do you do this with all your business decisions?

Funnily enough the current defining case is motor related. Google "Eddie Stobbart TUPE" for your own education, and then get your HR people and lawyers to deal with it! If they don't refer to the Stobbart case, be concerned!
