Hi,

Im hoping someone can help me out on a matter concerning a lease car i had and gave back at the end of last year.
I have just received a court summons through the post for failing to notify regarding the change of keeper.
Is this not the leasing companies job to do after i have handed the car back and the car has moved onto wherever it has gone next?
I had 2 lease cars at the same time and have not had the same trouble with the other car regarding changing the keeper records..
Can anyone shed any light on this scenario and also what are tho implications if i were to be found guilty of this i.e. penalty points, fine??

The RK is the lease company is it not? All our cars are registered to the lease company we just hand them back at the end of the term job done. Don't know if a personal lease is treated any differently though I suspect not. Did you ever have the V5 document? who's address is on that?

Personally I would forward it to the lease company and tell them to sort it ASAP. I would also follow the letter up as ignoring it would be foolish but you can't be held responsible for something that is nothing to do with you. You would not get points either just a fine but as its not your fault......

I'm assuming if the OP has received the letter then they've got his address from the V5?

I have just been notified that the v5 was actually in my name even though it was a lease vehicle on a 12 month lease. The car was handed back after the 12 months saying i had to do nothing from then on besides making sure the car was in good condition.
Anyway i have just spoke to the DVLA and to prevent it from going to court it was a £55 fine/charge. Would still be interested to hear if it was the lease company who was liable even though they had put the v5 in my name?

Who were the lease company? Did you actually have the V5? What do their terms state should happen with regards to the it at the end of the lease?

Was the V5 registered at your address, was it in the contract to say it would be in your name? How did the DVLA know the RK had changed unless somebody had told them?

If they had registered in my name, without me signing the transfer slip or stating it would be done in the contract I would be fighting it, that isn't a recommendation that you do, just my opinion wink

It may be worth getting some guidence from BVRLA - British Vehicle Rental and Leasing Association - which is the trade body. The have some very good guidence on a number of topics such as fair wear.

Is this a personal lease or business. I have never seen a business lease where the driver is the RK, all of ours have had the lease company as RP.

Its back to the old issue that the registered keeper is not the owner of the vehicle. The correct procedure is to register the keeper as the main driver.

Lease companies (wrongly in my opinion) keep the cars registered to themselves in the belief that it will cause them fewer problems in the long run.
I guess it does help to stop unscrupulous people from selling the cars.

When I had a leased Impreza from Subaru I was the registered keeper.

Get in touch with lease company and get them to sort it out.
