Items lost in the post - unfair 'contract' - advice welcomed
Discussion
They've failed to deliver the whole package, don't let them get away with it. My suspicion is that it had to be opened for whatever reason (customs?) and they failed to ensure that the package was correct re-secured afterwards. Ask them to point out in their terms of carriage where it specifies that a 'package' may consist only of a single box.
There is no customs activity between NL and DE so it is not what normally happens when you get something from the US (or anywhere outside of Europe).
Did the buyer mention that the tape etc was all cut off?
The notion of boxes / parcel, I have sent a parcel consisting of 2 tyres taped together - that was still a single parcel from a tracking point of view.

The item was accepted as 'one piece' by the post office when I took it in - indeed it was one piece due to the amount of tape attached.
Its cack-handed roughness, pure and simple. The even more annoying thing is that it should be pretty easy to find as the delivery only went through 2 sorting centres (one in Den Bosch and one in Dusseldorf) before reaching the delivery truck.
Only one box was labelled (hind sight is a wonderful thing), equally the woman in the PO only put the tracking and insurance stickers on to one box too, clearly indicating that she was happy that it was only one item, and not two.
TBH, its typical Dutch customer service - fk the customer! I like to think I have got a reasonable barometer as to what to suck up and what to fight, and this one smacks of deeply unfair, especially when Ive paid for the extra insured service.
Thanks all.
I know nothing about their laws over there but in your shoes I would be looking at their rules re Civil Courts, etc. It seems to me that this is one of those cases where they might think that they are right and that you are going to crawl away. On the other hand serve them with papers and you might well find that the reality of econmics means that it is easier to pay you off than fight their case, regardless of the veracity of their position. The item was accepted as 'one piece' by the post office when I took it in - indeed it was one piece due to the amount of tape attached.
