Have today topped up oil on my 75 diesel estate and now its right on top of dipstick about 1in over max mark, should I worry or drive as normal...

I wouldn't risk it - could bend a valve, you might be able to siphon some out through the dipstick if could knock up a small tube like instrument.

I wouldn't risk it. The extra oil around the crank could cause all sorts of havoc. If you can't drain it from the sump you could try a bit of poly tube down the dip tube but oil is a bit thick to siphon. A big syringe or a squeezy bulb primer type thing might do it. Failing that try sucking smile by which I mean put the poly tube into a container and seal it, then with another poly tube suck the air out of the container. Oil replaces the air and you don't get any in your mouth. Wine bottle and a drilled cork is a good one. Poly tube from B&Q's pond/water feature section

OK sorted local garage came out and siphoned some out, didnt charge as i am regular customer, excellent.
