A mate of mine (Goliath) said you guys on here might be able to advise on a situation my brother and myself have found ourselves in.

Basically we rent a lockup garage from a fellow villager, the plot is owned by the council but the garage by the other party.

My brother popped past the garage on Saturday and found a fresh lock, peeked over the top of the door to find an MX5 in there, not his Saxo Road rally car project, an Mi16 engine and box of a mate of mine, an S16 engine and spare S16 head, few sets of wheels and a fair bit of pug 205 and 405 spares redface

He called round the guy we rent the garage off and the story apparently goes that the lock was mashed off but not much taken, the door left open and a mess left, the council was onto the guy we rent off as its his name on the paperwork as far as I know, this is where it gets fking stupid, he apparently believed we had all moved to Scotland (my mum has) and made no attempt to contact us whatsoever, purely got a local scrap merchant to clear the garage, so err, WTAF?!

When this happened I am so far unsure, I don't recall when I popped up to the garage last but probably 4-6 weeks ago unfortunately, I don't know which shifted the stuff or where its gone, we will be calling past the local two scrap yards, both within two miles, one actually half a mile away the other side of the valley, it was a P plate Saxo VTS with a black roof, white inside and a black sparco cage, at the time it had no front panel on or gearbox, sitting on axle stands with no wheels on it as I was embarking on a BE4 gearbox conversion!!

so, what the hell do I do now?!

Sensible stuff. On the assumption that you were still paying the nice man his money, ask him to replace everything that he "sold". Depending on his reponse, be happy, or go legal.

Surely he knows what scrappie he contacted.

The car is probably toast but the parts could still be there. Time is of the essense on this.

Anything you can't recover I'd bill him for.
Does he realise that he is the wrong?

Look for them on Ebay and then find the link between the vendor and the chap you sub let the garage from.

Seems more logical that he has just flipped your stuff out for a turn.

His local pub landlord can probably tell you if he has form.

if your rent payments where up to date he had no business selling (stealing it) to a scrap merchant

OP, did you have a formal lease in place with the owner of the lockup?
Was the stuff insured against theft? Can you prove ownership of what's missing?

You could pursue the legal side of this and end up in court but all the time, effort and money involved would probably be better spent elsewhere. These sorts of disputes are usually best resolved between the parties. Try and be reasonable in your demands and consider both sides of the argument.

If you need a bit of leverage, I doubt very much that his lease from the council allowed him to sublet the garage (at a profit?).

I have pictures of most of the stuff that was in there, my brother has the car in his name, V5 etc, I can prove the engine block from my old Citroen ZX 16v is mine if found as I have the engine number on an old v5, but unfortunately not the engine number of my friends 1.9 MI16.

Unfortunately nothing in there insured

No profit was made on the rental of the garage, the fee was £80.50 per annum!

I don't know about sub-letting, as said, our verbal contract was with the garage's owner.

I dont know specifically, my brother was dealing with it but it dounds like he wasnt particularly bothered or interested.

just checked dvla online enquiry, no record for the reg number, so itz gone frown

Straight up case of TWOC I guess.

twoc'ing is joyriding

intent to permanently deprive you of your property is straight up theft.

I bet he got paid for the scrap.
