My tenant has told me via an email that he will be vacating at the end of his 2 month notice period. Does this mean that I have confirmation and can take it (and act upon it) as gospel, and be within the law?

Cheers.

No. People change their mind. People lie. People's circumstances change.
Until the keys are back they can withdraw their notice. Then you have to give....etc.
As someone who was told you can't rent a house because the purchase of the current tenant's house has fallen through, just before you are due to travel 200 miles with an already filled Rental Luton, this is quite annoying. (Did you spot the understatement)

I hear ya, thanks.
I couldn't imagine that situation....I'm feeling the palpitations just thinking about it.

You would be prudent to serve your own notice requiring possession. It is fairly standard for landlords to do this even where the tenant is plainly leaving consensually.

This happened to my mum, although not as bad as having a van loaded and ready to drive 200 miles. The landlord rang her the day before we were due to move from a temporary holiday let to tell her that they had decided they would not make as much money renting, and had decided to sell. To this day I hope they really suffered in the impending recession.

Be hopeful. As long as you have served the notice, there isnt much else you can do but sit and wait.

When 2 months are up and he doesnt move out, you get the legal ball rolling. Do NOT delay. It can take up to 4 months from filing the claim to getting a tenant out.

^^^^this, at the end of the two (2) months Notice, if the rental property is void of the tenant's possessions, effects etc., and you have received the entrance keys to the rental property, then, and only then can you accept the tenant's tenancy has been brought to an end.
