Irrespective of the legal implications I would suggest you get your wife to talk to HR about her concerns that in the unfortunate event of an accident that as the car share can't get the seatbelt on they could be injured.
Point out that the guilt feelings could potentially have a serious effect on your wife's mental state.
If HR are any good at their job they wont want the increased chance of 2 people off on sick pay that could be avoided by putting the car share in a more suitable vehicle, avoid references to trucks and trailers at this point wink

I think we'd be more concerned about issues such as Corporate Manslaughter than a bit of sick pay, and that's got to bring H&S back into the frame, or maybe the Company Insurance Team shirley wink

Regarding the weight of your wife's co-worker: Could you persuade your wife to visit a local weigh bridge in her car, on her own, then get her to go another time with twinkle toes on board, just so we know what we're dealing with?

And what are HR going to do, all she can do is see if she can find someone else to car pool with. I presume she doesn't have to take the large lady to walk as long as she car pools with someone else?

thanks - now I have this image of a huge backside sticking out of the doorway of an A3, wiggling and struggling to get to the twix whilst said car is rocking and bouncing!

What car does your wife drive OP. I've been out in my sisters Hyundai i30 this evening and I noticed that the rear seatbelt was very short.

Yes I am powerfully built but I'm only an apprentice director

And is that not going to be a result as far as the OPs wife is concerned, keeps the parking space and doesn't have to take a future contestant in the biggest loser to work anymore.
From the OPs original message the wife was given the car share heffer, don't imagine she would have a problem taking someone in who doesn't require strenghthened suspension to be fitted to her Polo.

As funny as this thread is, I can't see it going down too well with HR, dignity in the workplace and all that if you rock up and try the can I have a lighter car share buddy rather then the salad dodger I am currently partnered with.....

You can get an exemption from wearing a seat belt on medical grounds, weight being one of them so that might not fly

Edit: Having said that, if fatty can't wear a seatbelt she wouldn't get in if it was my car.. Well, she wouldn't get in at all. Period.
